AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE Cl.TY
OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 1845-G; CHANGE A TRACT
OF LAND OUT OF BLOCK B, GORDON HEIGHTS ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY,
TEXAS, FROM C-2 TO c-3 ZON I NG;iDI STRICT; SUBJECT TO coN'o ITIONS; PROVIDING A PENAL TY;
PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed change in zoning districts as hereinafter made has been
duly presented to the Planning· and Zoning· Commission for its recommendation which was
received by the City Councif and, after due consideration, the City Council finds
that making the proposed change as hereinafter set out will be in the public inter-
est; and; ·
WHEREAS, all conditions precedent required by law for a valJd amendment to the
Zoning Ordinance and Map have been fully complied with, as well as giving notices
in compliance with Section 26 of Ordinance No. 7084, as well as n6ticei provided by
Article lOllf, Vernon 1 s Annotated Civil Statutes·, amended in 1961, and notice was
duly published in the Lubbock.Morning Avalanche-Journal more than fifteen (15) days
prior to the date of the public he~ring before the City Council on such proposed
amendment, and the public hearing according to said notice was duly held in the
City Council Room on the second· floor of 'the City Hall, Lubbock, Texas, at which
time persons appeared in support of the p roposa 1 ; and, after said hear i_ng, it was
by the City Council detennined that it would be i~ the public interest, due to
changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the
ma~ner hereinafter set forth in ihe body of this Ordinanc~ and this Ordinance having
been introduced pri-or to first readi,ng hereof; NOW THEREFORE: ·
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION l. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same
are hereby amended as follows, to-wit:
ZONE CASE NO. 1845-G
A. Change a tract of land out of Block B, Gordon Heights Addition,
Lu~bock County, Texas, from C-2 to C-3 zoning dfstrict. THis
property is further described by metes and ·bounds as fo 11 ows:
BEGINNING at the Northwest ·:oerner of Tract B, Gordon
Heights Addition to the City of Lubbock, Lubbock County,
Texas;
THENCE East 299 feet to a point;
THENCE South 130.7 feet to a point;
THENCE East 100 feet to a point;
THENCE South 107 feet to a point;
THENCE West 107 feet toaa point;
THENCE South 110 feet to a point;
THENCE West 107 feet to a point;
THENCE North 110 feet to a point;
THENCE West 185 feet to a point;
THENCE North 230.7 feet to the PLACE OF BEGINNING.

SUBJECT TO THE FOLLOWING CONDITIONS:
I. That development and use of this property be in accordance with
the site p I an a·pp roved by the City Counc i l on March 23, 197 8,
and limited to recreational facilities.
2. That the building to be constructed on this property be not more
than 23 feet in· height and have no windows on the north side.

SECTION 2. THAT from and after passage and effective date of this Ordinance
said lots, tracts and parcels of land described in Section I hereof shall be changed
to the zoning district indicated and the Official Map is a·mended in accordance h·ere-
. with.
SECTION 3. THAT any person, firm or corporation owning or operating the subject
property failing to comply with the conditions imposed by Section 1 hereof shall be
guilty of a mfsdemeanor and upon conviction thereof, shall be subject to a fine not
to exceed TWO HUNDRED DOLLARS and each and every day's violation thereof shall con-
stitute a separate and distinct offense.
The failure of any corporation owning or operating the subject property to
comp 1 y with any of the conditions impos·ed by Section· l hereof sha 11 render the
President, Vice-President, General Manager, Local Manager and Local Agent liable
to the penalty prescribed in this seciion. ·
SECTION 4. THAT should any section, paragraph, sentence, clause, phrase or word
of this Ordinance be declared unconstitution·a1 or invalid for any reason, the remain
der of this Ordinance shall not be affected thereby.
SECTION 5-THAT the City Secretary is hereby authorized to cause publication of
the descriptive caption of this Ordinance as an alternative method provided by law.
AND IT IS SO ORDERED. '·
