HomeMy WebLinkAboutOrdinance - 7634-1978 - Ordinance Amending Zoning Ordinance No. 7084 To Make Change/Zone Case No. 1542-C - 03/23/1978, LGB:bsb ORDINANCE NO. 7634 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE Cl.TY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 1542-C; CHANGE A TRACT OF LANO OUT OF SECTION IO, BLOCK E-2, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM C-2 TO A-1 ZONING DISTRICT; SUBJECT TO A CONDITION; PROVIDING A PENALTY; PROVIDING A SAVl~tS CLAU~E AND PROVIDING FOR PUBLICATION. . .. ~.,~'".,~.-:-:-;~;~...:-: !.:-:"'--•!,' .: ··~ ~;,·r--.:. -~ WHEREAS, the proposed change in zoning districts as hereinafter made has: been du 1 y presented to the P 1 ann i ng· and Zoning· Commission fd r its recommendation which was received by the City Counc if and, after due ( c0ns i de ration, the City Counc i 1 finds that making the proposed change as hereinafter set out will be in the public inter- est; and,' · WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in 6ompliance with Section 26 ~f Ordinance No. 7084, as well as n6ticei provided by Article lOllf, Vernon 1s Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing acc·ording to said notice was duly held in the City Council Room on the second· floor of 'the City Hal 1, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest; due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the man.ner hereinafter set forth in t'he body of this Ordinance and this Ordinance having been introduced prior to first readi_ng hereof; NOW THEREFORE: · BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 7084 and the Official Zoni.ng Map BE and the same ~re hereby amended as follows, to-wit: Ii.. A. ZONE CASE NO. 15h2~C Ch~nge a tract of land out of Section 10, Block E-2, Lubbock County, Texas, from C=2 to A-1 zoning district. This property is further described by metes and boun.ds as fol lows: 0 B~G.olNNING at a goint which bears 2,182.85 feet, S89°57•3011W and 30.00 feet nMOO 02•3~1W from the Southeast corner of the North- east quarter (1/4) of Section 10, Block E-2, Lubbock County, Texas; THENCE S89°57 13011 W a distance of 288.25 feet; THENCE Noo0 02•3011w a distance of 165.50 feet; THENCE S89°57 1 30•·1W a distance of 138.50 feet; THENCE Noo0 02 1 3011w a distance of 494.95~feet to a point of curvature to the r:ight; THENCE Northeasterly around a curve to the right, said curve having a radc!,us of 15.00 feet, ta.ngent le.ngths of fs.oo feet, a delta a.n.gle of 90 00 10011, and a chord distance of 21.21 feet; THENCE N89°57 1 3011E a di stance of 4 l 1. 75 feet; THENCE Soo0 02•3011E a distance of 675.45 feet to the PLACE OF BEGINNING. . '. ,) LGB:bsb SUBJECT TO THE FOLLOWING CONDITION: 1. That development of this property be in accordance with the site plan approved by the City Council on March 23, 1978. SECTION 2. THAT from and after passage and effective date of this Ordinance said lots, tracts and parcels of land deicribed in Section 1 hereof shall be changed to the zoni_ng district indicated and the Official Map is amended in accordance here- with. SECTION 3. THAT any person, firm or corporation owning or operating the subject property failing to comply with the condition imposed by Section I hereof shall be guilty of a miidemeanor and upon conviction thereof, shall be subject to a fine not to exceed TWO HUNDRED DOLLARS and each and every day 1 s violation thereof shall con- stitute a separate and distinct offense. The failure of any corporation owning or operating the subject property to comply with any of the conditions imposed by Section ·1 hereof shal 1 render the President, Vice-President, General Manager, Local Manager and Local Agent liable to the penalty prescribed in this seciion. · SECTION 4. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutiona'l or i_nval id for any reason, the remain- der of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
