HomeMy WebLinkAboutOrdinance - 7608-1978 - Amending Zoning Ordinance 7084 Zone Case 2001-B - 01/26/1978LGB:yb ORDINANCE NO. 7608 < AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFI- CIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 2001-B; CHANGE A TRACT OF LAND OUT OF SEC- TION 1, BLOCK J-S, LUBBOCK COUNTY, TEXAS, FROM A-1 TO C-3 ZONING DISTRICT; CHANGE A TRACT OF LAND OUT OF SECTION 1, BLOCK J-S,LUB- BOCK COUNTY,. TEXAS, FROM C-2 TO C-3 ZONING DISTRICT; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning districts as::b ereinafter made have been duly presented to the Planning and Zoning Commission for its recommenda- tion which was received by the City Council and, after due consideration, the City Coup.ell finds that making the proposed changes as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal more than fif- teen (15) days prior to the date of the public hearing before the City Council on sucl proposed amendment, and the public hearing according to said notice was duly helc in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinaft-~r set forth in the body of this. Ordinance and this OrdinancE having been introduced prior to first reading hereof; NOW THEREFORE: ~. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 2001-B ) -_ .. Change a tract of land out of Section 1, Block J-S, Lubbock County, Texas, from A-1 to C-3 zoning district. This property is further described as the East 239.8 feet of the following tracl:described by metes and bounds: BEGINNING at a point which is 60 feet North and 1016. 4 feet West of the Southeast corner of Section 1, Block J-S; THENCE North O 0112011 East a distance of 6 8 3. 8 feet to a point in the South ROW line of Loop 2 89; THENCE South 53°31 West a distance of 329. 3 feet to a point of inter- section; THENCE South 47°20' West a distance of 329. 3 feet to a point of inter- section; ' .,. This property is further described by metes and bounds as follows: BEGINNING at a point which is 60 feet North and 1016. 4 feet West of the Southeast corner of Section 1, Block J-S; THENCE North 0°1'2011 East a distance of 683. 8 feet to a point in the South ROW line of Loop 289; THENCE South 53°31 West a distance of 329. 3 feet to a point of inter- section; THENCE South 47°201 West a distance of 329. 3 feet to a point of inter- section; THENCE South 47°201 West a distance of 165.1 feet to a point of curvature; THENCE along a curve to the left (radius equals 215 feet) a distance of 515. 3 feet to a point of tangency; THENCE North 89°58'2011 East a distance of 239. 85 feet to the PLACE OF BEGINNING; "LESS the East 239. 8 feet thereof. 11 SECTION 2. THAT from and after passage and effective date of this Ordi- nance said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accord- ance herewith. SECTION 3. THAT should any section, paragraph, sentence, clause, phrase or word of this ©rdinance be declared unconstitutional. or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.
