WHEREAS, the proposed changes in zoning districts as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendatio which was received by the City Council and, after due consideration, the City Coun cil finds that making the proposed changes as hereinafter set out will be in the pub lie interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well--as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article lOllf .. Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal more than fif teen (15) days prior to the date of the public hearing before the City Council on sucJ proposed amendment, and the public hearing according to said notice was duly helc in the City Council Room on the second floor of the City Hall, Lubbock, Texas.. at which time persons appeared in support of the proposal; and, after said hearing, i:t was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinanc having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows .. to-wit: ZONE CASE NO. 2178 1. Change a tract of land out of Section 18., Block E-2, Lubbock County, Texas, from R-1 to R-2 zoning district. This property is further de- scribed by metes and bounds as follows: BEGINNING at a point which bears Westerly an approximate distance of 1115 feet from the Northeast corner of said Section 18, Block E-2; LGB:yl;> THENCE Westerly an approximate distance of 155 feet; THENCE Southerly an approximate distance of 790 feet; THENCE Easterly an approximate distance of 155 feet; THENCE Northerly an approximate distance of 790 feet to the PLACE OF BEGI:NNING. 2. Change a tract of land out of Section 18, Block E-2, Lubbock County, Texas, from R-1 to C-2 zoning district. This property is further de- scribed by metes and bounds as follows: BEGINNING at the Northeast corner of said Section 18, Block E-2; THENCE S.~Jitberly an approximate distance of 635 feet; THENCE Westerly an approximate distance of 685 feet; THENCE Northerly an approximate distance of 635 feet; THENCE Easterly an approximate distance of 685 feet to the PLACE OF BEGINNING. 8. Change a tract of land out of Section 18, Block E-2, Lubbock County, Texas, from T to R-1 zoning district. This property is further de- scribed by metes and bounds as follows: BEGINNING at a point which bears Westerly an approximate distance of 121.0 feet from the Northeast corner of said Section 18, Block E-2; THENCE Westerly an approximate distWlce of 1370 feet; THENCE Southerly an approximate distance of 2640 feet; THENCE Easterly an approximate distance of 2640 feet; THENCE Northerly an approximate distance of 1850 feet; " , THENCE Westerly an approximate distance of 1270 feet; THENCE Northerly an approximate distance of 790 feet to the PLACE OF BEGIT\INING. 4. BEGlliNING at a point which bears Southerly an approximate distance of 635 feet from the Northeast corner of said Section 18, Block E-2; THENCE Westerly an approximate distance of 685 feet; THENCE Northerly an approximate distance of 635 feet; THENCE Westerly an approximate distance of 430 feet; THENCE Southerly an approximate distance of 790 feet; THENCE Easterly an approximate distance of 1115 feet; THENCE Northerly an approximate distance of 155 feet to the PLACE OF BEGINNlliG. SUBJECT TO THE FOLLOWING CONDITION~~f 1. That the South 155 feet of this A-1 tract be limited to 1-story.apartments. SECTION 2. THAT from and after passage and effective date of this Ordi-~ nance said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended·'in accord- ance herewith. SECTION 3. THAT any person, firm or corporation owning or operating the subject property failing to comply with the conditions imposed by Section 1 hereof shall. be guilty of a misdemeanor and upon conviction thereof, shall be subject to a fine not to exceed TWO HUNDRED DOLLARS and each and every day's violation thereof shall constitute a separate and distinct offense. The failure of any corporation owning or operating the subject property to com ply with any of the conditions imposed by Section 1 hereof shall render the Presi- dent, Vice-President, General Manager, Local Manager and Local Agent liable to the penalty prescribed in this section. SEC.T.ION 4. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, 1, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publica- tion of the descriptive caption of this Ordinance as an alternative method provided by law. LGB:yb AND IT IS SO ORDERED.
