AN ORDINANCE ABANDONING AND CLOSING A GARBAGE COLLECTION EASEMENT CONTAINED IN
AN UNDERGROUND UTILITY AND GARBAGE COLLECTION EASEMENT LOCATED IN PART OF THE EAST
140 FEET OF LOT 1, BLOCK 1, ELLWOQD PLACE ADDITION TO THE CITY OF LUBBOCK, LUBBOCK
COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED HEREINAFTER IN THIS ORDINANCE; DIRECT
ING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDON-
ING AND CLOSING; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council finds that the garbage collection part of an under-
ground utility and garbage collection easement as hereinafter described in the body
of this ordinance is no longer needed for public use and it would be to the public
interest to close, vacate, and abandon the same; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT said garbage collection part of an underground utility and
garbage collection easement is described as follows:
All of the 20 feet wide (strip of land) garbage collection
easement within the East 140 feet of Lot l, Block l, Ellwood
Place Addition to the City of Lubbock, Lubbock County, Texas,
BE AND THE SAME IS HEREBV. CLOSED, VACATED AND ABANDONED.
The underground utility use easement (contained in said under-
ground utility and garbage collection easement) is hereby for
all purposes retained by the City of Lubbock, Texas.
SECTION 2. THAT the City Engineer shall mark said abandoning and closing on
the official maps of the City, giving the number of the Ordinance, and its date of
final passage.
SECTION 3, THAT the City Secretary is hereby authorized and directed to cause
the publication of the descriptive caption of this Ordinance as an alternative
method of publication as provided by law.
AND IT IS SO ORDERED.
