HomeMy WebLinkAboutOrdinance - 7628-1978 - Ordinance Providing For Establishment Of System Of Fiscal Notes/Non-Budgeted - 02/28/1978ORDINANCE NO. 7628 AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF A SYSTEM OF FISCAL NOTES FOR ORDINANCES THAT REQUIRE THE EXPENDITURE OF NON-BUDGETED CITY FUNDS OR THAT REQUIRE ANY NEW LOCAL TAX, FEE, LICENSE CHARGE, OR PENALTY OR THAT REQUIRE AN INCREASE OR DECREASE IN ANY EXISTING LOCAL TAX, FEE, LICENSE CHARGE OR PENALTY. WHEREAS, the City Council has determined a need to provide asysten to make the citizens, the City Council ahd the City organization aware of the fiscal implications of proposed projects and expenditures; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: The City Manager shall establish a system of fiscal notes for ordinances or resolutions that require the expenditure of non-budgeted City funds or that require any new local tax, fee, license charge, or penalty or that require an increase or decrease in any existing local tax, fee, license charge or penalty. The system of fiscal notes shall be capable of providing thefiscaJ implications of the measure and the total probable cost to the City (including options for source of funds to cover any probable cost) or the amount of any increased or decreased revenue, as applicable, for the first five years after its passage and a statement as to whether or not there will be a cost or increased or decreased revenue after five years (including a statement of options for source of funds to cover any costs after five years). The City Manager shall prepare a fiscal note for any ordinance or resolution that requires the expenditure of non-budgeted City funds (including options for source of funds to cover the non-budgeted expenses) or that requires any new local tax, fee, license charge or penalty, or that requires an increase or decrease in any existing locru tax, fee, license charge or penalty. The City Manager shall first determine whether the fiscal implica- tions of the ordinance or resolution can be ascertained and whether a determination thereof can be reasonably made within fifteen (15) days from the date the resolution or ordinance is proposed. If the fiscal implications cannot be ascertained, then the City Manager shall so indicate to the City Council, giving reasons, in which case the infor- mation given the City Council shall in all ways be sufficient hereunde1. If the fiscal implications cannot be reasonably ascertained within fifteen (15) days, then the City Manager shall so indicate to the City Council, giving reasons, in which case the City Council may request that a fiscal note be prepared and provide additional time for its completion. If, after receiving the fiscal note from the City Manager stating that the fiscal implications cannot be reasonably ascertai~ed in fifteen (15) days, the City Council does not request that the fisca note be prepared and provide additional time for its preparation, then the information given the City Council shall in all ways be sufficient hereunder. . l _, x J :yt, If an ascertainment of the fiscal implications can be made within fifteen (15) days, the City Manager f3hall return the completed fiscal note to the City Couhcil ithin fifteen (15) d~ys~m the date the ordinance or resolution is proposed. In preparing the fiscal note. the City Manager shall utilize information or data supplied by any person, agency, organization. or governmental unit deemed by the City Manager to be reliable. The City Manager shall state in the fiscal note the sources of the information and data used and shall indicate to what extent he or she relied on the information and data in preparing the fiscal note. In the event an ordinance or resolution is amended by the City Council so as to alter its fiscal implications, the City Manager shall prepare a revised fiscal note. AND IT IS SO ORDERED.
