HomeMy WebLinkAboutOrdinance - 7612-1978 - Ordinance Abandoning/Closing Portions Of Street 13Th Between Avenue V/Vernon - 02/09/1978JWF:bsb I 7&/~ ORDINANCE NO. 7612-----, AN ORDINAl~CE ABANDONING AND CLOSING THE FOLLOWING PORTIOWS OF STREET: A PORTION OF 13TH STREET BETWEEN AVE~IDE nv" AND VERNON AVENUE, THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULA.r..~Y DESCRIBED IN THE BODY OF nus ORDINANCE; DIRECT- ING THE CITY ENGINEER TO MARK THE OFFICIAL MAP OF THE CITY OF LUBBOCK TO INDICATE THE CLOSING AND ABANDONHENT OF THAT CERTAIN STREET: PROVIDING A SAVINGS CLAUSE AHD PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the Street portions hereinafter described are no longer needed for Street purposes and for public use; and, WHEREAS, the City Council finds it would be to the public interest to close, vacate and abandon the same for Street purposes and to public use; and NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Street portions as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for street purposes and for public use: A portion of 13th Street between Avenue 11V11 and Vernon Avenue, being more particularly described as follows: BEGINNING at a point in the North line of 13th Street, said point being the Southeast . corner of Block 72, Overton Addi- tion to the City of Lubbock, Lubbock County, Texas; THENCE West, along the North line of said 13th Street, a dis- tance of 293.25 £eet to a point that intersects the East line of Vernon Avenue; THENCE South, along the East line of said Vernon Avenue, a distance of 60.00 feet to a point in the South line of 13th Street; THENCE East, along the South line of said 13th Street, a dis- tance of 293.25 feet to a point in the West line of Avenue 11V"; THENCE North, along the West line of Avenue 11V", a distance of 60.08 feet to the PLACE OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official map of the City of Lubbock to indicate that the Street described in Section 1 hereof has been closed and abandoned, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason , the remainder of this Ordinance shall not be affected thereby, SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
