AN ORDINANCE AMENDING CHAPTER 4, SEC. 4-30, OF THE CODE OF ORDINANCES OF
THE CITY OF LUBBOCK, TEXAS, BY REDUCING THE COST FOR AN ANNUAL LICENSE FEE TO
$1 WHEN SUCH ANIMAL IS IMMUNIZED AGAINST RABIES IN CONJUNCTION WITH AN ANNUAL
RABIES CLINIC OR DRIVE IN WHICH THE CITY OF LUBBOCK PARTICIPATES AS A Sl'ONSOR
OR JOINT SPONSOR; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION AND
DECLARING AN EMERGENCY.
WHEREAS, the City Council has determined that it would be in the best
interest of the health, safety and general welfare of the citizens of the City
of Lubbock to amend Sec. 4-30 of Chapter 4 of the Code of Ordinances to encourage
citizens to have their dogs immunized against rabies; and
WHEREAS, the City Council finds that such immunizations should be obtained
as soon as possible in the best interest of the health, safety and general
welfare of the citizens of the City of Lubbock, which creates an emergency
requiring the immediate passage of this measure; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF '11-IE CITY OF LUBBOCK, TEXAS:
SECTION 1. THAT Chapter 4, Section l+-30 of the Code of Ordinances of
the City of Lubbock BE and is hereby amended to read as follows:
Sec. 4-30. Expiration, renewal of license; issuance of license certificate
and tag.
(a) Licenses shall expire one year from the date issued if not
revoked and must be renewed before or upon that date.
(b) Upon immunization of animal against rabies by a licensed
veterinarian, payment of a license fee of two dollars ($2.00)
and a written application stating name, address, and description
of animal, the city enforcement agent or a veterinarian appointed
for such purpose may issue to the owner a license certificate and
a metallic tag for each animal so licensed. The tag shall have
stamped thereon the year for which it is issued and the number
corresponding with the number on the certificate.
(c) The annual license fee hereinabove set out shall be reduced
to one dollar ($1.00) if such animal is immunized against rabies
at an annual rabies immunization clinic or drive sponsored or
co-sponsored by the City of Lubbock,
SECTION 2. THAT should any section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid for
any reason, the remainder of this Ordinance s hall not be affected thereby.
SECTION 3. TI-IAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.

SECTION 4. THAT the fact that public necessity and convenience requires
that this Ordinance be passed as an emergency measure for reasons set forth in
the preamble hereof, therefore the rule requiring chat no Ordinance shall be
finally passed on the day of its introduction is suspended, and this Ordjnance
is declared to be an emergency measure to take effect from and a fter Its passage
and publication as set forth hereinabove .

Members of the Lubbock Humane Society will appear to r equest waiver
of the $2.00 l icensing fee for dogs during the annual rabies clinic
on May 19, 1979.

The ·Lubbock Humane Society is planning to hold a rabies clinic on
Hay 19, 1979, and r.:'quests that the $2.00 licensing fee for dogs
be waived during the period the clinic is being held. Mr , Crites
indicated that the clinic held in 1978 reflected a decrease in
participation over 1977, it being the feeling of the Society that
the nonwaiver of t he $2.00 fee being the cause, It is t he feeling of
the Society that should the waiver be gran ted, there would be at
least 15,000 animals vaccinated on the day of the clini c ; that if
the fee is waived, the Society would provide all personnel, the
tags used, and personnel from the Society would handle all the paper-
work.
City Attorney John Ross indicated that the manner i n which this would
be handled would be to amend the existing ordinance to reflect whatever
action the Council decided upon, snid ordinance being passed on
emergency basis, and reflecting that it be [or the day of the clinic
onl y; that additiona lly an agreement would need to be executed with
the Society r efl ecting all the tenns , conditions and responsibilities
to be assumed by the Society and at no cost to the City.
The discussion that followe d reflected that it W3S in the best interest
of the citizens for the City to be involved in the cl inic inasmuch as

they had the responsi bility of follo~-up enforcement for violations,
impoundment of animals and related ma tters. Councilman McAl ister
indicated that this presentation was a bit di.[ferent from wh11t Mr.
Crites pres~nted to him on the phone in that on the phone h e had
requested a reduction of the fee from $2.00 to $1.00, and he, too,
felt the City needs to participate in the event; that the City should
furnish tags and some personne l during the event.
Councilman Adert on inquired whether or not the Society had contemplated
any promotional program to reduce the animal population, to which the
response was that they are persuing an active program i n this area ,
although it is a very difficult problem to h~ndle ln reeducat i ng the
the citizenry to the value of an animal control program ,
Following all discussion, the motion was made by Councilman McAlister,
seconded by Councilwoman Jordan to r e duce the licensing fee from $2.00
to $1.00 for the period of the rabies clink to be held on Hay 19, 1979,
and for the City to provide the necessary tngs and personnel throughout
the event. Motion carried: Nayar West, Mayor Pro Tem Henry, Council -
woman Jordan, Councilmen Adl!rton and McAlister voti.ng Yea; none voting
Nay. The ordi nance reflecting this action will appear on the May 10,
1979 agenda to be considered as an emerge:ncy measure .

Dear Mayor West:
While rabies has been on the ups wing, l ast year the
Lubbock Humane Society's Rabies Clini c attracted one third
the number of people as i n y ears past. We believe that this
is due to the increase i n the cost of l ivi ng, as pet care is
traditional ly one a rea where cuts are made. T hus, we (the
Lubbock Humane Society ) would like for the City of Lubbock
to waive the licensing charge of $2.00 for the Lubbock
Humane Society Rabies Clinic each y ear. This reduction in
cost, coupled with a discount of $6.00 for the Rabies and
Distemper vaccinations , would offer the citizens of Lubbock
an $8.00 savings and thus encourage them to a ttend t he
Rabies Clinic.

1. 1 out of every 200 people in the United States will be
bitten by a domestic animal this year.
2. 30,000 people will undergo treatment for rabies this
year.
