HomeMy WebLinkAboutOrdinance - 7849-1979 - Amending Zoning Ordinance 7084 Zone Case 2229 - 05/10/1979T.C!R • cl ORDINANCE NO. 7B49 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 2229; CHANGE A TRACT OF LAND OUT OF SECTION 78, BLOCK A CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-1 TO R-2 ZONING DISTRICT; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Planning and Zoning Commission for its reconnnendation which was received by the City Council and, after due consideration, the City Council finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes,·amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 2229 Change a tract of land out of Section 78, Block A, City of Lubbock, Lubbock County, Texas, from R-1 to R-2 zoning district. This property is further described by metes and bounds as follows: BEGINNING at a point in the North line of Sunset Lane and the West R.O.W. line of Interstate Highway 27, for the Southeast and beginning corner of.this parcel, whence the Southwest corner of Section 78, Block A bears West, 4504.34 feet and South 821.95 feet; THENCE North 20°43'24" East along the West R,O.W. line of Interstate Highway 27, a distance of 324.97 feet to a point, for the corner of this parcel; THENCE North 29°48'28" East along the West R.O.W. line of Interstate Highway 27, a distance of 369.82 feet to a point, for the Northeast corner of this parcel, and the Northeast corner of Lot 6; THENCE North 80°201 00" West along the North line of Lots 6 & 7 and the South line of an alley, a distance of 268.74 feet to a point, for the Northwest corner of Lot 7; ' , . •,· ... LGB:cl THENCE Southwesterly, along the arc of a curve to the right, and along the East R.O.W. line of Meadow Drive, an arc distance of 180.00 feet to the P.T. of said curve, said curve has a radius of 1610.00 feet, a central angle of 06°24'21" and a chord that bears South 13°06'50" West, 179.91 feet; THENCE South 16°19'00" West along the East R.O.W. line of Meadow Drive, a distance of 448.02 feet to the P.C. of a curve to the left and corner of this parcel; THENCE Southeasterly along the arc of a curve to the left, an arc distance of 24.42 feet to a point in the North R.O.W. line of Sunset Lane for a corner of this parcel, said curve has a radius of 15.00 feet, a central angle of 93°16 1 30" and a chord that bears South 30° 19'15" East, 21.81 feet; THENCE Southeasterly along the arc of a curve to the right and along the North R.O.W. line of Sunset Lane an arc distance of 130.54 feet to the Place of Beginning, said curve has a radius of 490.00 feet, a central angle of 15°15'50" and a chord that bears South 69°19'35" East, 130.15 feet. SECTION 2. THAT from and after passage and effective date of this Ordinance said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith. SECTION 3. THAT violation of any provisions of this ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 4. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
