N. HODGES ADDITION, CITY OF LUBBOCK, TEXAS, TO ALLOW WAREHOUSING INCIDENTAL TO RETAIL SALES; PROVIDING FOR CONDITIONS, PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE, PROVIDING FOR A SAVINGS CLAUSE AND PRO- VIDING FOR PUBLICATION. WHEREAS the City Council finds that after all notices have been given and hearings held as provided by law, that it is in the best interest of the citizens of the City of Lubbock to make the change in the zoning law as here- inafter set forth; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinances No. 4444 and 4743 of the City of Lubbock, Texas BE and are hereby amended to allow warehousing incidental to retail sales on Lots E-30 through E-42, C. N. Hodges Addition, City of Lubbock, Lubbock County, Texas; SUBJECT TO THE FOLLOWING CONDITIONS: 1. That all overhead and warehousing door openings shall be on the. alley side of the building. 2. That all office space be fronting onto Villa Drive, and office space should not be less than 1/3 of total floor area. SECTION 2. THAT violation of any provisions of this ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 3. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of ·this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
