HomeMy WebLinkAboutOrdinance - 7816-1979 - Amending Zoning Ordinance 7084 Zone Case 2217 - 03/08/1979-•• . -... \ . 11 'i, ; ' \ , I:/. ! \,, t1 ' ,L ' . :...J' ' ., ' • i ·, :, ; ; :: F LGB:hw, \' \ ORDINANCE NO. 7816 ------- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF.LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2217; CHANGE TWO T~CTS.OF LAND OUT OF SECTION 27, BLOCK E-2, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS\ FRO~ R-1 TO A-1 ZONING DISTRICT; SUBJECT TO CONDITIONS; PRO- VIDING FOR A PENAI.,TY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning districts as hereinafter made have been duly presented to the Planning and Zoning Connnission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that making the proposed changes as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche- Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner here- inafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: :BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 2217 A. Change a tract of land out of Section 27, Block E-2, City of Lubbock, Lubbock County, Texas, from R-1 to A-1 zoning district. This property is fur- ther described by metes and bounds as follows: :BEGINNING at .a point in the South line of 68th Street, said point bearing South 511.94 feet and West 390 feet from the Northeast corner of said Section 27, Block E-2; THENCE West, along the South line of 68th Street, an approximate dis- tance of 930 feet; THENCE South an approximate distance of 286 feet; THENCE East an approximate distance of 160 feet; THENCE South an approximate distance of 92 feet; THENCE East an approximate distance of 170 feet; THENCE North an approximate distance of 114 feet; THENCE East an approximate distance of 600 feet; ... SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the building set-back lines be as shown on the site plan signed by the Mayor on February 22, 1979. 2. That all buildings total to having a 1:.493 floor/area ratio. 3, That the development be limited to 133 units. 4. That the entire plat be recorded at one time. 5. That before building permit is issued, final site plan be approved by the City Council. B. Change a tract of land out of Section 27, Block E-2 1 City of Lubbock, Lubbock County, Texas, from R-1 to A-1 zoning district. This property is fur- ther described by metes and bounds as follows: BEGINNING at a point that bears South 889.94 feet and West 990 feet from the Northeast corner of said Section 27, Block E-2; THENCE West an approximate distance of 170 feet; THENCE North an approximate distance of 92 feet; THENCE West an approximate distance of 160 feet; THENCE South an approximate distance of 270 feet; THENCE East an approximate distance of 45 feet to a point of curvature; THENCE Northeasterly around a curve to the left, said curve having an approximate chord distance of 75 feet to a point of reverse curvature; THENCE Northeasterly around a curve to the right, said curve having an approximate chord distance of 75 feet; THENCE East an approximate distance of 140 feet; THENCE North an approximate distance of 150 feet to the POINT OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITION: 1. That the permitted use be limited to townhouses. SECTION 2. THAT from and after passage and effective date of this Ordinance said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith. · LGB:hw SECTION 3. THAT violation of any p~ovisions of this ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 4. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
