DGV:hw ORDINANCE NO. 7812 AN ORDINANCE AMENDING SECTION 11-5 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, PROVIDING FOR DISCONTINUANCE OF ELECTRIC SERVICE FOR FAILURE TO PAY CHARGES; PROVIDING FOR A RECONNECTION CHARGE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock has determined that the charges hereinafter set out would be in the best interest of the citizens of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 11-5 of the Code of Ordinances of the City of Lubbock BE and is hereby amended to read as follows: Sec. 11-5. Di~continuance of service for failure to pay. In ~he event any user or customer of the city's electric light system does not pay matured rates and charges within fifteen (15) days from the date the same became due and payable, it is hereby made the duty of the director of utilities, sales and service to disconnect elect- ric service unless said user or customer has appeared and shown sub- stantial reason why such action should not be taken. Whenever the am- ount past due and delinquent is paid by such user or customer, such ser- vice may be resumed, but there shall be charged and collected a recon- nection charge of six dollars ($6.00) for reconnection during normal working hours and fifteen ($15.00) for reconnection outside normal working hours. Normal working hours are 8 a.m. to 5 p.m. on weekdays excluding City of Lubbock holidays. Such service shall also be disconnected when a user or customer fails to pay for water service rendered by the City of Lubbock. SECTION 2. THAT should any section, paragraph, sentence, clause, phrase or word of this ·ordinance be declared unconstitutional or invalid for any reason, the remainder of this ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
