AN ORDINANCE AMENDING SECTION 34-23 OF THE CODE OF ORDINANCES OF THE CITY
OF LUBBOCK, TEXAS, PROVIDING FOR DISCONTINUANCE OF WATER SERVICE FOR FAILURE
TO PAY CHARGES; PROVIDING FOR A CHARGE FOR TURNING WATER BACK ON; PROVIDING A
SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council of the City of Lubbock has determined that the
changes hereinafter set out would be in the best interest of the citizens of
the City of Lubbock; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 34-23 of the Code of Ordinances of the City
of Lubbock BE and is hereby amended by amending the first paragraph thereof to
read as follows:
"If, within fifteen (15) days after the date of a mature and due
water bill, the amount due is not paid, it will be sufficient notice
from the consumer to discontinue service unless such consumer shall
appear and show substantial reason why such service should not be
discontinued, and such service shall be discontinued and not re-estab-
lished until the full amount due has been paid, plus an additional
charge for turning water back on in the amount of six doll.ars ($6. 00)
for turn on during normal working hours or fifteen dollars ($15.00) for
turn on outside normal working hours. Normal working hours are 8 a.m.
to 5 p.m. on weekdays excluding City of Lubbock holidays. In the fur-
ther event that it is necessary to cut off service at the corporation
to prevent unauthorized usage, an additional amount of fifty dollars
($50.00) shall be paid in addition to any past due amounts. Such ser-
vice shall also be discontinued when a consumer fails to pay for elec-
tric service rendered by the City of Lubbock.
SECTION 2. THAT should any section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid for
any reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 3. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative method
provided by law.
