AN ORDINANCE AMENDING ORDINANCES NO. 4251 AND 4955 OF THE CITY OF LUBBOCK BY
REPEALING CERTAIN 20 M.P.H. SCHOOL ZONES MORE PARTICULARLY DESCRIBED IN THE
BODY OF THIS ORDINANCE AND REESTABLISHING THE PRIMA FACIE SPEED LIMITS ESTABLISHED
BY ARTICLE 6701d. SECTION 166 (a)(l), VERNON'S TEXAS CIVIL STATUTES. PROVIDING
A SAVINGS CLAUSE, PROVIDING FOR A PENALTY CLAUSE AS PROVIDED FOR IN SECTION 1-
5 OF THE CITY CODE AND PROVIDING FOR PUBLICATION,
WHEREAS, the governing body of the City of Lubbock, upon the basis of an
engineering and traffic investigation finds it no longer necessary to provide
for certain 20 M.P.H. school zones and wishes to reestablish the prim.a facie
speed limits heretofore established by Art. 6701d, Sec. 166 (a)(l), Vernon's
Texas Civil Statutes as amended Acts 1963, 38th Legislature, page 455, Chapter
161, NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 4251, Section 2, Part 6 BE and is hereby
repealed and that there be reestablished on 4th Street beginning 40 feet from the
west side of the intersection of Avenue E and extending west for 606 feet the
prima facie speed limits established by Art. 6701d, Sec. 166 (a)(l), V.T.C.S. as
amended Acts 1963, 38th Legislature, page 455, Chapter 161.
SECTION 2. THAT Ordinance No. 4251, Section 2, Part & BE and is hereby
repealed and that there be reestablished on Avenue Hat the north side of the
intersection of 3rd Street and extending north for 544 feet the prima facie speed
limits established by Art. 6701d, Sec. 166 (a)(l), V.T.c.s. as amended Acts 1963,
38th Legislature, page 455, Chapter 161.
SECTION 3. THAT Ordinance No. 4955, BE and is hereby repealed and that
there be reestablished on 50th Street beginning 150 east of the east property
line at Quirt Avenue and extending west for 400 feet the prima facie speed limits
established by Art. 6701d, Sec. 166 (a)(l), V.T.C.S. as amended Acts 1963, 38th
Legislature, page 455, Chapter 161.
SECTION 4. THAT should any section, paragraph, sentence, clause, phrase
or word of this Ordinance be declared unconstitutional of invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars
as provided in Section 1-5 of the City Code.
SECTION 6, THAT the·City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinante as an alternative
method provided by law.
