'5707 AN ORDINANCE REPEALING CHAPTER 33 OF THE CODE OF ORDINANC jOF THE CITY OF LUBBOCK, TEXAS, ENTITLED "TRAILER COACH PARKS" AND IN LIEU THEREOF ENACTING A NEW CHAPTER 33, ENTITLED 11MOBILE HOMES AND VACATION TRAVEL TRAILER PARKS"; DEFINING TERMS USED IN THE ORDINANCE; PROVIDING FOR LOCATION OF SUCH FACILITIES; PROVIDING FOR BUILDING PERMITS AND CODE COMPLIANCE; PROVIDING FOR AN ANNUAL LICENSE; PROVIDING FOR A REGISTER OF OCCUPANTS; PROVIDING FOR GENERAL REQIDREMENTS; PROVIDING FOR SANITATION FACILITIES; PROVIDING FOR GARBAGE DISPOSAL; PROVIDING FOR FIRE PROTECTION; PROVIDING FOR SUPERVISION; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock finds that a need exists for providing health and safety requirements and regulations of the operation of mobile home parks and vacation travel trailer parks within the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 33 of the Code of Ordinances of the City of Lubbock, Texas, entitled "Trailer Coach Parks," BE and is hereby repealed. SECTION 2. THAT the Code of Ordinances of the City of Lubbock, Texas, BE and is hereby amended by adding thereto a new Chapter 33, which shall read as follows: "CHAPTER 33" MOBILE HOMES AND VACATION TRAVEL TRAILER PARKS ...._ - 11Section 33-1 Definitions The following definitions shall apply in the interpretation and enforcement of this chapter: Mobile Home. Mobile home means any vehicle or similar portable structure, including expanding and double width units, designed for long-term occupancy which arrives at a mobile home site as a complete dwelling. Such unit shall be ten (10) feet or more in width and more than thirty-five (35) feet in length • Vacation Travel Trailer. Vacation travel trailer is a vehicular portable ._., structure designed for a temporary or short-term occupancy for travel, recreational or vacation uses. Such vehicle shall include v.acatipn travel trailer, pick-up camper, converted bus, tent-trailer, or similar device used for temporary portable housing. These units shall be eight (8) feet or less in width and thirty-five (35) feet or less in length. Mobile Home Park. Mobile home park means any tract of land under single ownership, eight acres or mo.re, where accomodation is provided for non-transient mobile home use. Vacation Travel Trailer Park. Vacation travel trailer park is any tract of land under single ownership, two acres or more, where accom.odation is provided for transient trailer use. Mobile Home or Vacation Trailer Space. Mobile home or vacation travel trailer space means a plot of land within a mobile home or vacation travel trailer park designated for the accomodation of a single mobile home or vacation travel trailer. Mobile Home or Vacation Travel Trailer Stand. Mobile home or vacation travel traile,r stand is that hard surfaced area of a mobile home or vaca- tion travel trailer space that is reserved for the placement of a mobile home or vacation travel trailer. Each mobile home stand shall be pro- vided with adequate 11tie downs" to secure the super structures against uplift, sliding, rotation and overturning. Hard Surface. Hard surfaced shall mean a weatherproofed surface that shall not soften when exposed to water and shall be of sufficient thickness to withstand normal wheel loads. Space Width. The horizontal distance between the side lot lines, measured at right angles to the lot depth at a point midway between the front and rear lot lines. "Section 33-2 Location. It shall be unlawful for any person to locate a mobile home park or vacation travel trailer park within the city limits except as provided in Sections 14-A. 1 and 12. 1 of the Zoning Ordinance. "Section 33-3 Building Permits and Code Compliance. All new construction permitted hereby shall comply with the requirements and standards set out in all relevant sections of the city code, including but not limited to, subdivision regulations, building code, plumbing code, electrical code, sidewalk ordinance and Zoning Ordinance. -2- Mobile home parks and travel trailer parks in existence upon the effective date of this chapter shall comply with Sections 33-3, 33-4, 33-5, 33-6(5-8), 33-71 33-8, 33-9, 33-10 when updating their existing facilities. Updating shall mean major remodeling or replacement of existing facilities, but shall not include normal maintenance. 11Section 33-4 License. An annual license is required for each mobile home park or vacation travel trailer park. (1) Fee, The annual fee for each mobile home park or vacation travel trailer park shall be twenty-five ($25. 00) dollars for the first twenty (20) mobile homes or vacation travel trailer , stands and one ($1. 00) dollar for each additional stand. This annual license can be issued when the owner shows written evidence that the mobile home park or vacation travel trailer park and its facilities have been inspected and approved by the City-County Health Department and by the City Fire Department not more than thirty (30) days prior to the date of license appli- cation. This non-transferable license may be obtained at the City Tax Office. The City Tax Department shall send out notices thirty (30) days before expiration date and follow up to insure this annual licens is obtained. (2) Display. The license certificate shall be conspicuously posted in the office located on the premises of the mobile home park or vacation travel trailer park at all times. (3) Revocation. The license to maintain and operate a mobile home park or vacation travel trailer park shall be revol{ed by the City Tax Department upon ten (10) days' notice when recommen ded by the City-County Health Department, Building Inspector or Fire Department on the finding of a violation of any provision of this chapter. A new license may be issued if the circum- stances leading to revocation have been remedied and new license fee paid. "Section 33-5 Register of Occupants. It shall be the duty of the licensee to keep a register containing a record of all mobile home and vacation travel trailer owners and occupants located within the park. This register shall be kept for a period of seven (7) years and be readily available for inspection by law enforcement officers, publi health officials and other officials whose duties necessitate acquisition of the information contained in the register. The register shall contain the following information: (1) Name and address of each occupant. (2) The make, model and year, license number and state of registration of all automobiles, mobile homes and vacation travel trailers. (3) The date of arrival and departure of each mobile home and vacation travel trailer. "Section 33-6 Requirements Generally. All mobile home parks and vacation travel trailer parks constructed in whole or in part after the effective date of this ordinance shall conform to the following requirements: (1) A Specific Use Permit zone change shall be secured for mobile home parks. Vacation travel trailer parks shall be located in a C-4 or manufacturing district. (2) Density. The following maximum densities shall apply to mobile home parks and vacation travel trailer parks: Mobile Homes -7 per acre Vacation Travel Trailers -12 per acre (3) Initial development of any mobile home park shall not be less than 8 acres fully improved with serviced spaces. All site plans shall define the initial development area. (4) Mobile home and vacation travel trailer minimum setback and spacing requirements: Spacing: Mobile Vacation Home Travel Traile between mobile structures 15' 101 end to end parking 10' 6' -Setbacks: from permanent structures (excluding individual storage structures, patio roofs and carports) 101 5 1 from patio roof or carport of one mobile structure to adjacent mobile structures 3' 3' -4- . Mobile home parks shall provide storage facilities of 120 cubic feet minimum on each mobile home space (6) Patio Roofs and Carports. Mobile home and vacation travel trailer spaces may have open unenclosed patio roofs and car- ports of metal, fiberglass or other incombustible materials. (7) Utilities. (a) Water Supply. An adequate supply of potable water for domestic and fire protection purposes shall be supplied to meet the requirements of the park. Mobile home and vacation travel trailer spaces shall be provided with a water hookup at least four inches above the ground and hose connection for lawn maintenance. (b) Sewage Disposal. Waste from showers, bathtubs, toilets, lavatories in mobile homes, vacation travel trailers, and service o.r other buildings within the park shall be dis- charged into a public sewer system in compliance with applicable ordinances. In the event public services are not available such waste shall be discharged into a private disposal system approved by the City-County Healtp unit. (c) Natural Gas. Mobile home and vacation travel trailer space shall be provided with a natural gas hookup at least four inches above the ground. (d) Electrical Service. Underground service shall be provide I throughout mobile home parks and vacation travel trailer parks and service to individual mobile homes and vacation travel trailers shall meet the requirements as set forth in Chapter 11 of this Code. All electric meters shall be permanently installed in a location accessible from an interior street, alley o.r all weather walk way. (8) Lighting. (a) Entrances and exits to mobile home parks and vacation -5- ./ u travel _trailer parks shall be lighted with one (1) or more luminaires (or fixtures) totalling 7700 lumens • (b) The interior area of the mobile home park or vacation travel trailer park shall be lighted to . 5 candle average maintained. All luminaires shall be mounted fifteen (15) feet to twenty-five (25) feet above ground level. (9) Walks. All interior walks of mobile home parks and vacation travel trailer parks shall be all-weather and not less than four (4) feet in width. Walks provided adjacent to interior streets shall be three (3) feet concrete gutter-walks. Walks provided adjacent to public streets shall comply with Chapter 28 of this Code. (10) Interior Streets. Interior asphalt streets shall be provided to service each mobile home and vacation travel trailer space. All spaces shall abut upon such paved interior street which shall connect with a public street. Interior streets where on- street parking is pe.rmitted shall not be less than thirty-five (35) feet in width. In mobile home parks and vacation travel trailer parks where no on-street parking is permitted the interior streets shall not be less than twenty (20) feet in width. All streets shall have standard curb and gutter except where three (3) feet gutter walks or drives are stipulated. No cul-de-sac streets shall be over 250 feet from center of the turn, around to the nearest curb line of the street it abuts. At the end of each cul-de-sac, a six (6) feet wide open, unobstruc- ted fire fighting easement shall be provided. This easement shall not be more than 200 feet in length and shall abut and open onto a private or public street other than a cul-de-sac. Gates may be installed in such opening, provided break-away locks are used. (11) Ingress and Egress. All mobile home parks and vacation travel trailer parks shall have a double drive entrance separated by a thirty (30) feet median and a secondary access street at least 300 feet from this double entrance. Such streets shall have standard curb and gutter and shall not be less than twenty (20) feet in width. Secondary access street can be chained for control as long as a break-away lock is used. Entrances and exits must comply with the provisions of Chapter 28 of this Code. (12) Driveway or Accessway. A driveway or accessway shall be reserved from the street to the mobile home or vacation travel trailer stand. -6- 0 (13) Parking. Twp off-street paved parking spaces shall be provided for each mobile home space and two additional guest paved parking spaces shall be provtcied in a common area for each three mobile homes in the park. Such parking spaces shall not be over 300 feet from the mobile homes they serve. Vacation travel trailer parks shall provide one automobile parking space for each vacation travel trailer space and one additional guest parking space shall be provided in a common area for each four vacation travel trailer spaces in the park. Such parking spaces shall not be over 200 feet from the travel trailers they serve. (14) Recreation Area. A landscaped recreation area or areas totaling not less than 8% of the total mobile home park site shall be provided. Such recreation area shall be provided in a central location where possible, and may be divided so as not to exceed one such recreation area per five acres of gross mobile home park area. Regardless of location each recreation area's smallest dimension shall be not less than fifty feet. Community buildings and community use facilities, adult recreation and chil play areas and swimming pools may be included in these recreation areas. This area shall be protected from traffic hazards. 11Section 33-7 Sanitation Facilities, Vacation travel trailer parks shall provide toilets, baths or showers, and other sanitation facilities which shall conform to the following requirements: (1) The toilet and other sanitation facilities for males and females shall be either in separate buildings or shall be separated, if in the same building, by a soundproof wall. Such service buildings shall be well lighted and ventilated at all times with screened openings. These service buildings shall be maintained in clean, sightly condition and kept free of any condition that could menace the health of any occupant. Service buildings shall be located not closer than five feet (5 1) nor farther than two hundred feet (2001) from any vacation travel trailer space. (2) An adequate supply of hot water shall be provided at all times in any required service buildings, and for all bathing., washing., cleansing and laundry facilities. (3) Toilet facilities (a) Males. Toilet facilities for males shall consist of not less than one flush toilet for every fifteen vacation travel trailers, one urinal for every fifteen vacation travel trailers., one shower with :individual dressing accomodatio for every t:¥ _vacation travel trailers. (b) Femalys. Toilet facilities for females shall consist of not less than one flush toilet for every ten vacation travel trailers, one shower with individual dressing accomodations for every ten vacation travel trailers. 11Section 33-8 Disposal of Garbage and Rubbish. Mobile home parks and vacation travel trailer parks shall provide a sufficient number of dumpsters to handle the refuse generated by their occupants, Such dumpsters shall be located in designated areas where ptckup will be made by the City. 11Section 33-9 Fire Protection. Mobile Homes (1) Each mobile home shall contain a five pound CO2 fire extinguisher at all times. (2) Fire hydrants shall be installed so that no mobile home space will be over 300 feet from a hydrant setting on an 8 inch :water main. (3) There shall not be any storage under the mobile home. (4) Fences around mobile homes shall not be over 34 inches high across the front of the space. Vacation Travel Trailers (1) Each vacation travel trailer shall contain a five pound CO2 fire extinguisher at all times. (2) Fire hydrants shall be installed so that no vacation travel trailer space will be over 200 feet from a hydrant setting on an 8 inch water main. (3) There shall not be any storage under the vacation travel trailer. Mobile home park and vacation travel park licensee shall be responsible · for maintaining the conditions of this section. The City Fire Marshall shall make periodic inspections of these parks to insure the above condi- tions are maintained. '1Section 33-10 Supervision. A responsible attendant or supervisor, owner or operator shall be in charg -8- V at all times to keep the mobile home and vacation travel trailer park> its facilities and equipment 'in a clean, orderly and sanitary condition and he shall be answerable> with the licensee, for any violation of the provisions of this chapter. " SECTION 3. Should any paragraph1 sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the rema:in ... der of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause the publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
