AN ORDINANCE AMENDING CHAPTER 18 OF THE CODE OF ORDINAN0ES
OF THE CITY OF LUBBOCK, ENTITLED 11MOTOR VEHICLES AND TRAFFIC, "
BY AMENDING SECTION 18-82 THEREOF ESTABLISHING SPEED RESTRICTION
WITHIN THE CITY;; AUTHORIZE THE PLACING OF SPEED LIMIT SIGNS;
PRESCRIBING A PENALTY; PROVIDING FOR PUBLICATION; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE
SHALL BE CUMULATIVE EXCEPT OF THOSE PRIMA FACIE SPEED LIMIT
ORDINANCES WITH WHICH IT SPECIFICALLY CONFLICTS; AND PROVIDING
A SAVINGS CL.A USE.
WHEREAS, the governing body of the City of Lubbock, desiring to establish
speed restrictions within the City of Lubbock which conform to Article 6701d,
Section 166(a)l, Vernon's Texas Civil Statutes, and acting within its authority
granted by Article 1175 (20), Vernon's Texas Civil Statutes, finds that the speed
limit that is prima facie evidence that speed in excess thereof is not reasonable
or prudent and is unlawful shouttl-be as stated below herein; NOW THEREFORE.,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 18-82 of Chapter 18, entitled rrMotor Vehicles
and Traffic, 11 of the Code of Ordinances of the City of Lubbock, BE and is hereby
amended to read as follows:
11Section 18-82. Speed restrictions -Generally.
It shall be unlawful for any person to operate or drive a motor
vehicle within the corporate limits of the City of Lubbock at
a speed greater than is reasonable and prudent under the circum-
stances then existing. Except as otherwise provided in this
section, and in ordinances establishing prima facie speed limits
on certain designated streets, and except when a special hazard
exists that requires lower speeds for compliance with Article
6701d, section 166{b), Vernon1s Texas Civil Statutes, any speed
in excess of thirty (30) miles per hour shall be prima facie evi-
dence that the speed is not 1:'easonable or prudent and that it is
unlawful.
Where the governing body of the City has determined upon
the basis of an engineering and traffic investigation that the prima
facie maximum speed limit set forth herein above is greater or
less than is reasonable or safe under the conditions found to exist
at any intersection or other portion of a street or highway and has
declared a reasonable and safe prima faci~ maximum speed limit
thereat or thereon by ordinance duly enacted and has directed and
authorized the City Manager to cause the placing of signs giving
notice thereof, it shall be unlawful for any person to operate or

drive a motor or other vehicle at a speed greater than the
maximum prima facie speed limit shown on such sign. "
SECTION 2. The City Manager is authorized and directed to cause the
placing of signs so as to clearly define the limits of the prima facie areas set
out in this Ordinance.
SECTION 3. Any person, firm or corporation violating the prima_· facie
speed limit established by this Ordinance shall, upon conviction. be fined any sum
not to exceed TWO HUNDRED AND NO/100 ($200. 00) DOLLARS.
SECTION 4. The City Secretary is authorized and directed to cause the
publication of the descriptive caption of this Ordinance together with the penalty
as an alternative method of publication provided by law. This Ordinance shall
become effective ten (10) days after the date of its last publication.
SECTION 5. THAT all Ordinances or parts of Ordinances conflicting with
any of the provisions hereof are hereby repealed insofar as such conflict exists.
SECTION 6. THIS Ordinance shall be cumulative of all other prima facie
speed limit Ordinances except those with which it specifically conflicts.
SECTION 7. Should any section, paragraph, sentence, clause, phrase, or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
