AN ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF
THE PRIMA FACIE SPEED LIMIT FOR ALL VEHICLES ON THE FOLLOWING
STREETS IN THE CORPORATE LIMITS OF THE CITY OF LUBBOCK~ LUBBOCK
COUNTY, TEXAS1 TO-WIT: A 35 MPH SPEED ZONE ON BOTH SIDES OF.
QUAKER AVENUE BETWEEN 19TH STREET AND BROWNFIELD IDGHWAY; A
35 MPH SPEED ZONE ON BOTH SIDES OF BROADWAY BETWEEN A VENUE Q
AND UNIVERSITY A VENUE; AND A 40 MPH SPEED ZONE ON BOTH SIDES OF
EAST BROADWAY BETWEEN AVENUE A AND IDALOU ROAD; AUTHORIZING
THE PLACING OF SPEED LIMIT SIGNS; PRESCRIBING A PE'MALTY; PROVIDING
FOR PUBLICATION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
PROVIDING THAT STREETS OR HIGHWAYS NOT SPECIFICALLY SET FORTH
HEREIN SHALL NOT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT
THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER PRIMA FACIE
SPEED LIMIT ORDINANCES EXCEPT THOSE WITH WHICH IT SPECIFICALLY
CONFLICTS; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS1 the governing body of the City of Lubbock, as authorized by
Article 670ld, Section 169(b} Vernon's Texas Civil Statutes, finds that certain
prima facie speed limits on certain highways are different from what is reason-
able or safe and should be altered as her~inafter set forth, NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. The prima facie speed limit established by Article 6701d,
Section 166(a)(l)--Vernon's Texas Civil Statutes is altered and changed for all
vehicles on the following designated highways or streets in the corporate limits
of the City of Lubbock, Lubbock County, Texas:
A 35M. P. H. speed zone on both sides of Quaker Avenue between 19th
Street and Brownfield Highway.
A 35 M. P. H. ,speed zone on both sides of Broadway between Avenue Q
and University Avenue.
A 40 M. P. H. speed zone on both sides of East Broadway between
A venue A and Idalou Road.
SECTION 2. The City Manager is authorized and directed to cause the
placing of signs so as to clearly define the limits of the prima facie areas set out
in this Ordinance.
SECTION 3. Any person, firm, or corporation violating the prima facie
speed limit,._established by this Ordinance shall upon conviction be fined any sum
not to exceed TWO HUNDRED ($200. 00) DOLLARS.
SECTION 4. The City Secretary is authorized and directed to cause the
publication of the descriptive caption of this Ordinance together with the penalty
as an alternative method of publication as provided by law.
SECTION 5. That all ordinances or parts of ordinances conflicting with
any of the provisions hereof are hereby repealed insofar as such conflict exists.
SECTION 6. That all highways or streets not specifically set forth in
the preceding sections hereof shall not be affected by the provisions hereof,. and
this Ordinance shall be cumulative of all other prima facie speed limit ordinances
except those with which it specifically conflicts.
SECTION 7. Should any section, paragraph, sentence, clause, phrase, or
word of this Ordinance be declared unconstitutional or invalid for any reason the
remainder of this Ordinance shall not be affected thereby.
SECTION 8. This Ordinance shall become effective ten (10) days
after the date of its last publication.
