AN ORDINANCE AMENDING ZONING ORDINANCE NO. 5406, WlfiCH
AM.F.NDED ZONING ORDINANCE NO. 1695 OF THE CITY OF LUBBOCK~ BY
REPEALING CONDITIONS 1., 2 AND 3 ESTABLISHED THEREIN; ESTABLISHING
A NEW CONDITION IN LIEU OF SUCH REPEALED CONDITIONS; PROVIDING A
SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council finds that, after all notices have been given and
fhearings held as provided by law, it is in the best interest of the citizens of the
:City of Lubbock to make the change in the Zoning Ordinance as hereinafter set
forth, NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Zoning Ordinance No. 5406 of the City of Lubbock BE and
s hereby amended by repealing conditions 1, 2 and 3 established in Section 1 of
such Ordinance. The property affected by such conditions being a tract of land
t>etween 50th Street and 51st Street and Orlando Avenue and Memphis Avenue.
SECTION 2 •. THAT Zoning qrdinance No. 5406 of the City of Lubbock BE
:md is hereby amended by establishing a new condition to be added to Section 1
hereof, which condition shall be in li-eu of the conditions repealed hereinabove
:md shall govern the property stated hereinabove and shall read as follows:
"1. Development of the property subject to these conditions shall
maintain a parking ratio of 2. 2 square feet of paved off-street
parking area for each square foot of total building area and shall
further comply with the building set backs and other requirements
shown on the plan adopted and made a part hereof by the City Council
on May 21, 1969; said plan being on file in the office of the Secretary
of the Planning and Zoning Commission. 11
SECTION 3. THAT the conditions repealed in Section 1 hereinabove shall in
~o way affect the remaining conditions in Ordinance No. 5406 and such remaining
~onditions shall remain in full force and effect.
SECTION 4. Should any section, paragraph., sentence, clause, phrase~ or
1vord of this Ordinance be declared unconstitutional or invalid for any reason, the
emainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City f)ecretary is hereby authorized to cause publica-
ion of the descriptive caption of this Ordinance as an ·alternative method provided
~Y law.
