HomeMy WebLinkAboutOrdinance - 5658-1969 - Amending Zoning Ord. # 1695 And Lubbock Map For Changes: Zone Case #1602 - 05/21/1969= -Ordinance No. 5658 amended by Ordinance No. 5815. -05 -ZJ -<P'l ou-12-LJCJ ORDINANCE NO. 5658 -=:;;.;;;.. __ _ AN ORDINANCE AMENDING ZONING ORDIN"ANCE NO. 1695 AND THE OFFI- CIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 1602: CHANGE LOTS 1 THRU 6, BLOCK 10, SOUTH PORT ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM AN "R-1" TO A 11C-4" ZONING DISTRICT; SUBJECT TO CONDITIONS; PROVIDING FOR A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS,. the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its reco:r;nmendatio .. which was received by the City Council and, after due consideration, the Ctty Council finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 16<:1)5 as well as notices pro vided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal more than fif- teen (15) days prior to the date of the public hearing before the City Council on sue proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at wh:Leh time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 1602 Change Lots 1 thru 6, Block 10, Southport Addition, City of Lubbock, Lubbock County, Texas, from an "R-1 11 to a "C-4" Zoning District. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The use permitted on the subject property shall be limited to a new car dealership. plus "R-111 uses. 2. That a 6' high solid permanent type wooden or masonry screening fence be constructed and permanently maintained along the north an east property lines. Said fence to be erected prior to or concurrent with the first building permit on the property. No vehicular type openings shall be permitted in the fence. 3. That a paved off..:street parking ratio of 3 square feet of parking area for each square foot of total building area be observed. 4. That a 25' building setback be observed from Avenue Q and from 44th Street. SECTION 2. THAT from and after passage and effective date of this Ordi- nance said lots, tracts and parce Is of land described in Section 1 hereof shall be changed to the Zoning District indicated and the Official Map is amended in accord ance herewith. SECTION 3. Should any paragraph, sentence~ clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remain- der of this Ordinance shall not be affected thereby. SECTION 4.
