AN ORDINANCE AMENDING ORDINANCE NO. 3420 TO ADD THE FOLLOW
ING DESCRIBED SCHOOL ZONE SPEED LIMITS IN SECTION 1 OF ORDINANCE
NO. 3420, ESTABLISHING PRIMA FACIE SPEED LIMITS AT 20 .MILES PER HOU
DURING SCHOOL HOURS IN SUCH ZONES; DEFINING "SCHOOL HOURS11 ; MAKIN~
IT UNLAWFUL TO PASS WITHIN SCHOOL ZONES; PRESCRIBING PENALTY FOR
VIOLATIONS, PROVIDING FOR PUBLICATION AND DECLARING AN EMERGENC •
WHEREAS, the governing body of the City of Lubbock, upon the basis of an
Engineering and Traffic Investigation finds it necessary to alter prima facie speed
limits established by Article 827a, Section 8, Subsection 1 (b) 1, Vernon's Annota""
ted Penal Code as amended Acts 1951, 52nd Legislature, Page 589 Chapter 346,
within the areas and at the locations named and designated in the body of this
Ordinance, all within the corporate limits of the City of Lubbock and in the immed·-
ate vicinity of school areas during periods of time when schools are in session and
school children are going to or from schools and playgrounds therewith; and,
WHEREAS, the governing body also finds it necessary to make provisions
for the regulation of moving vehicular traffic within such areas regarding passing
and stopping for the protection and safety of pedestrians crossing the streets II
within such areas; and,
WHEREAS, it is necessary to the immediate preservation of the public healt
and safety to provide for the immediate enactment of such measures constituting
an emergency; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 1 of Ordinance No. 3420, City of Lubbock, Texas
BE and the same is hereby amended b y the addition thereto at the end thereof of
the following locations and areas which are hereby declared to be school zones andf
the prima facie speed limit of thirty (30) miles per hour as established by ARTICL
827a, Section 8, Subsection 1 (b) 1~ is hereby altered and changed to twenty (20)
miles per hour for all vehicles, during school hours as herein defined on the
following described streets, to-wit:
1134. On 50th Street beginning 350 feet East from the East side of
the intersection of Avenue P and extending West for 650 feet;
35. On 50th Street beginning approximately 75 feet East from the
East side of the intersection of Yanda Avenue, and extending
West for 600 feet.
36. On Avenue A beginning approximately 300 feet North from the
North side of the 38th St reet intersection and extending South
for 600 feet. 11
SECTION 2. The Traffic Engineer is hereby authorized and directed to caus
the placem~nt of traffic.. control signals and/or portable signs at each approach to
each schoc:W zone herein designated. The signs shall be placed in the center of the
Street or at the most advantageous point within the traffic lanes to be conspicuous
to approaching vehicular traffic.
SECTION 3. "School hours11 as that term is used herein, shall be the hours
between 7:30A.M. and 4:30P.M. of each Monday through Friday throughout the
calendar y$r when the school nearest the school zone is in session.

SECTION 4. It shall be unlawful for any person to drive or operate a i

SECTION 5. It shall be unlawful for any person to drive or opez:.~t~ ~ .y:ee.~cle,
through the school zones herein designated during school hours at a rate of speed
in excess of the prima facie speed limits herein designated for such school zones.
SECTION 6. Any person violating the prima facie speed limit established byj
this Ordinance shall upon conviction be fined as prescribed by the provision of
Article 827a, Vernon's Annotated Penal Code for violations of Section 8 thereof
and any person violating any other Section of this Ordinance shall upon conviction
be fined in a sum not exceeding $200. 00.
SECTION 7. If any part or parts of this Ordinance shall be held unconstitu-
tional or invalid by any court of competent jurisdiction, such part or parts shall
be deemed a separate , distinct a nd independent provision and such holding shall
not affect the remaining portions hereof.
SECTION 8. That all Ordinances or parts of Ordinances conflicting with an
of the provisinashereof are hereby repealed insofar as such conflict exists.
SECTION 9. That the City Secretary is hereby directed to cause publication
of the descriptive caption of this Ordinance together with the penalty clause as an
alternative method provided by law.
SECTION 10. That the enactment of this Ordinance being necessary to the
public safety and welfare of the pedestrian use of the streets in the school zones
herein designated and established is hereby declared to be an emergency measure
creating a public necessity that the rule providing that proposed ordinance be
presented at two spear ate meetings be dispensed with and this Ordinance is declare .
to be an EMERGENCY MEASURE to take effect from and after the date of its first I
publication.
