SO AS TO ADD PARAGRAPHS REGULATING ACCESSIBILITY AND LOCATION OF WATER HEATERS; REQUIRlNG MASTER PLUMBERS TO DISPLAY FIRM NAME AND LICENSE NUMBER ON ALL MOTOR VEffiCLES USED IN BUSINESS; REQUIRING INSTALLATION OF KITCHEN AND SIMILAR FACILITIES TO COMPLY WITH HEALTH REGULATIONSAND REQUIRING PLUMBERS TO INQUIRE AS TO SUCH REGULATIONS; AUTHORIZING USE OF FIBRE PIPE ONLY FOR RESIDENTIAL CONSTRUCTION AND UNDER SPECI- FIED CONDITIONS; RE-ESTABLISHING REQUIREMENTS FOR WASTE AND VENT LINES; RAISING CERTAIN PERMIT FEE LISTED; SETTING REQUIRE- MEN'ISFOR WATER PIPES AND FITTING INSTALLED UNDER CONCRETE FLOORS; REQUIRING EXCAVATIONS FOR WATER• SEWER AND GAS SERVICE LINES TO BE SO PLANNED AND ARRANGED AS TO ALLOW INSPECTION OF ALL SUCH LINES TO BE MADE AT THE SAME TIME; RAISING PLUMBER1S BOND AMOUNT TO THREE THOUSAND DOLLARS; REPEALING SECTION PER- TAINING TO GAS FITTER~S BOND; ESTABLISHING BOND AND OTHER CONDI- TIONS FOR GAS APPLIANCE• LAWN SPRINKLER AND WATER SOFTENER DEALERS AND INSTALLERS; ESTABLISIUNG LAWN SPRINKLERS AND WATER SOFTENER SYSTEM SPECIFICATIONS; SETTING FEES FOR LAWN SPRINKLER AND WATER SOFTENER INSTALLATION PERMITS AND INSPECTIONS; ESTAB- LISlllNG NEW REQUIREMENTS AND SUGGESTED ROUGH FOR DISPOSAL• KITCHEN SINK AND DISHWASHER INSTALLATIONS; AMENDING FEES FOR REPAIRlNG PAVING CUT; PROVIDING A PENALTY AND A SEVERABILITY CLAUSE; AND PROVIDING FOR PUBLICATION OF DESCRIPTIVE CAPTION AND PENALTY PROVISION AS PROVIDED BY LAW AND AN EFFECTIVE DATE FOR THIS ORDINANCE. WHEREAS. the Plumbing Board has heretofore approved and recommended certain revisions to the Plwnbing Code as more fully eet out in the body of this Ordinance; and1 WHEREAS. the City Commission finds that such revisions to the Plwnbing Code are necessary and essential to the public safety and in the interest of the citizens of the City of Lubbock and should be made; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Sec. Z4-5Z and Sec. Z4-89 of the ·code of Ordinances of the City of Lubbock, the same appearing in the Plwnbing Code of Volume II of said Code of Ordinances, both section BE and they are he reby amended by the addition to each of such sections, at the end thereof, of the following sentence, to-wit: 11All spaces where water heaters are located should be accessible for repair and replacement, no door jams or headers shall obstruct pipe connection on top of the heater. u SECTION Z. THAT the Plwnbing Code, the same appearing in Volume II of the Code of Ordinances of the City of Lubbock, Texas, BE and the same is here- by amended by the addition thereto of the following new section, designated Sec. Z4-9. 11 which shall read hereafter in full as follows, to-wit: "Sec. Z4-9. 1. Master plumber to display information on vehicles. All master plumbers engaged in any activity within the definition of the word plumbing as used in this Chapter, shall haw his firm name and his Master Plumber1s license number conspicuously . I displayed on all motor vehicles used by his firm in the trans- action of his business as a Master Plumber. Such information shall appear in lettering of not less than three inches (3") in height. 11 SECTION 3. THAT Sec. Z4-Z8 of the Plumbing Code, the same appearing in V o1ume li of the Code of Ordinances of the City of Lubbock, Texas, BE and the same is hereby amended by the addition at the end thereof of a new paragraph which shall read as follows, to-wit: "Installation of all food handling and kitchen equipment in restaurants, cafes, and all other business establishments devoted to furnishing edible foodstuffs to the public for consumption, shall be in conformity with the requirements of this chapter and all regulations of the State Health Department and the City-County Health Department. Any plumber, undertakir.ginstallation of such equipment, shall. prior to roughing in, contact such health departments as to then existing health regulations which might affect the mode of installation to be followed. 11 SECTION 4. THAT the 6th sentence of the Znd paragmph of Sec. 24-70 of the Plumbing Code,. the same appearing in Volume li of the Code of Ordinances of the City of Lubbock, Texas, which now reads: "Tile or approved fibre pipe may be used to within three feet of the outside of any building wall, with bell holes provide :i and joints to be caulked with hemp, and poured with an approved compound. 11 BE, and the same is hereby amended to read hereafter as follows. provided that the remainder of said Sec. 24-70 shall never be construed as affected by the amend- ment of .this one sentence, to-wit: uTile or approved fibre pipe may be used in residential construction to within three feet of the outside of any wall, with bell holes provided and joints to be caulked with hemp, and poured with an approved compound. 11 SECTION 5. THAT Sec. 24-41 of the Plumbing Code, the same appearing in Volwne li of the Code of Ordinances of the City of Lubbock, Texas, BE and the same is hereby amended to read hereafter in full as follows, to-wit: "All pipes and fittings used for waste and vent lines shall be of kind and grade as follows: Cast iron soil pipe and fittings shall be of grades known to the trade a1 11extra heavy11, conforming to A. S. T. M,; specifications, serial designation A -74-44 or subsequent revisions, and shall be coated with asphaltwn or coal tar pitch. Waste and vents for one and two stories may be medium s<?fl pipe conforming to A. S. T. M. s pacifications. Duriron Pipe and £i tting s or othe r approved acid r e- ais.tigg material may be used in this construction. Cast iron threaded pipe and fittings of two inch diameter or less may be used for exposed vents only. Lead pipe used for waste, vent or flush pipe must not be of lighter weight than that know :1 to the trade as "extra light. 11 Brass pipe used for waste or vent line (as provided for in this chapter) shall be of iron pipe size and weight, type "L", hard temper copper tubing and drainage fittings. specifications A. s. T. M,; Standard galvanized steel and iron pipe or D.; W,; Y. copper pipe may be used as vents above the over- flow level of the fixture in fixture units of two or less, except in masonry walls. All clay pipe and fittings ua.ed for house sewers shall be number one vitrified clay pipe• which shall meet all the requirements of the American Society for Testing Mate rials, serial designation C 13-24, or subsequent revisions. This pipe and fittings shall have been inspected and stamped by an independent laboratory satis- factory to the city plumbing inspector at the expense of the supplier. Bituminized fibre drain and sewer pipe meeting commercial standard C.; S. 116-44 or later revi sions, as published by the U.;S.Department of Commerce, Bureau of Standards, may be used only in residential sewe r lines to within three feet of the house. Whe e bitum.inized fibre pipe is used, only the adaptors and fittings specifically made for this pipe are to be used, and all work is to be pla-ced according to the latest ap- proved methods of construction. 11 u ; SECTION 6. THAT the lst paragraph of Sec. 24-24 of the Plumbing Code, the same appearing in Volume II of the Code of Ordinances of the City of Lubbock, Texas,. BE and the same is hereby amended to read hereafter in full as follows, the 2nd paragraph of said Sec. 24-2.4 not to be affected by this amendment, to-wit: 11The sum of one dollar for one fixture, or roughing in, and seventy-five cent1 for all additional fixtures, shall be paid as a permit and inspection fee for fixture! ,proposed to be placed in the work clescribed in the application for such permit un- der this ordinance. That said sum shall be paid by the Master-Employing Plumbe , to whom the pennit is issued under the .. terms of this ordinance at the time said permit is issued. By the term 11fixtures11 as used herein, is meant each water closet,. sink,. bath tub, basin, (lavatory) or section of basin in battery, drinking fountain, soda fountain, urinal, laundry tray, or section of laundry tray, washing machine (where connected to water or sewerage). sand trap, catch basin, sump, shower drain, slop sink• dental Guspidor, fountain cuspidor, dishwashing machine garbage disposal, hot water heater, water softeners, wall heaters, floor furnace, and all other receptacles that may be classed as plumbing fixtures. The permit and inspection fee shall apply to floor and cellar drains, septic tanks and sewers, water and waste connections for any air conditioning or refrigerating apparatus, fees to be paid for on the same basis as plumbing fixtures. The sum of one dollar, fifty cents shall be paid for each inspection of any gas piping and one dollar for inspection any alteration of work or extension or repair in any building. Any gas fired furnace having a floor or wall register, which requires a special vent pipe, shall be subject to a fee of one dollar and each additional furnace unit on same building seventy-five cents. 11 SECTION 7. THAT Sec. 24-54 of the Plumbing Code• the same appearing in Volume II of the Code of Ordinances of the City of Lubbocka Texas, BE and the same is hereby amended by the addition thereto of the following pam.gmph to read as follows, to-wit: "Water pipes installed under concrete floors shall be looped or manifold above the floor surface. For fitting used under concrete slab floort 95-5 soldie.r shall be used on all joints and an air test of 100 pounds shall be put on the water pipes at the time of the rough plumbing inspecti<n. 11 SECTION 8. THAT Sec. 24-70 of the Plumbing Code, the same appearing in Volume II of the Code of Ordinances of the City of Lubbock~ Texas, BE and the same is hereby amended by the addition thereto of the following pamg.m.ph to read as follows, to-wit: 11 • 110n all new construction, excavations for water .. sewer and gas service lines• shall be so planned and armnged as to allow inspection of all such lines to be made at the same time. 11 SECTION 9. THAT the words "one thousand dollars" appearing in the 1st sentence of Sec. 2.4-13 of the Plumbing Code1 the same appearing in Volume ll of the Code of Ordi nances of the City of Lubbock, Texas, BE and the same are here- by amended to read hereafter as follows, to-wit: 11 Three Thousand Dollars. 11 SECTION 10. THAT Sec. 24-14 of the Plwnbing Code, the same appearing i11 Volume II of the Code of Ordinances of the City of Lubbock, Texas, BE and the same is in all things hereby REPEALED. it being the intention of the City Com- mission to completely repeal and delete all provisions of said Section pertaining to gas fitter1s bond as originally adopted in par. 2.-4-1 of Ordinance No. 981 of the City-of Lubbock., SECTION 11. THAT the Plumbing Code• the same appearing in Volume II of the Code of Ordinances of the City of Lubbock, Texas1 BE and the same is hereby amended, by the addition thereto of a new section to be designated Sec. 2.4-141 the same to read hereafter in full as follows, to-wit: . "Sec. Z4-14. Gas appliance dealerts1 lawn sprinkler, and water softener bond; conditions. rfl'~ ~. No person, firm or corporation shall enter upon the installation, &eaetl'v'" "' ~· • •• ··~ ~"";""'; ~r of any gas piping, gas appliance, lawn sprinkler or ~ ~~ water softener piping;, fixtures or apparatus or any change thereof., nor shall any "-' . ~ person undertake for any other person the adjustment thereof, until such person., firm or corporation shall have delivered to the city a good and sufficient surety bond in the sum of three thousand dollars ($3, 000. 00) to be approved by the city attorney of the city. Such surety bond shall be with a surety company duly autho- rized to do business in the state, conditioned for the faithful performance of all such work entered upon or contracted for in strict accordance and compliance with the terms, requirements and provisions of this chapter and other ordinances of the city. Such bond shall be further conditioned that such contracting principal shall, without additional cost to the person for whom the work is done, remedy an defect therein due to faulty workmanship or incorrect construction or due to the faulty material furnished or used. All sureties on any bond ~quired by the city shall be liable for breach thereof to the owner of the property and any other per- son actually damaged by such breach not to exceed the face amount of such bond; provided, that written notice of such damage and probable amount thereof is given to the surety company within ten days after the discovery of the damage1 and in no event not later than ten days after the completion or abandonment of the work by such person. No pexmit shall be granted and no walk started on the contract until such bond has been filed and approved by the city attorney, and provided further.-that liability on such bond for the full amount thereof shall continue until the surety has given the city written notice of cancellation or of the amount of claims of which it has been notified, in which event the contracting principal on such bond shall not pur sue work further until a bond for the full amount is filed and approvedl . SECTION 1Z. THAT the Plumbing Code, same appearing in Volume ll of the Code of Ordinances of the City of Lubbock, BE and the same is hereby amended by adding thereto the following section, to be designated Section 24-14.1, which shall read hereafter in full as follows, to-wit: 11Sec. Z4-14. 1. Lawn sprinkler and water softener systems, specifications. 1. That lawn-sprinkler systems installed, constructed or reconstructed shall be equipped with a backflow preventer on the discharge side of each of the last valves. The backflow prevente.r shall be at least six (6) inches above the highest head, and at no time less than six (6) inches above the surrounding ground Where combination control valves and backflow preventers are installed, the bot- tom of the valve shall constitute the bottom of the backfiow pmventer. (See Ap- pendix C, page 46, National Plumbing Code) A licensed and bonded plumber shall obtain a permit and call for inspec- tions when making connection to the water supply and running necessary line a to - include the vacuum breaker. Properly installed the sprinkler dealer may run lines to any area so long as all tie to vacuum. breaker outlet. z. All supply and waste connections to water softener designed to be serviced on premises and/or tied into or connected to sewer shall be made by licensed and bonded plumbers. A permit and inspection is required. 3. That unlicensed installation and service men may perform such of the work herein contemplated to the extent such work and such individuals are ex- pressly exempt from the licensing requirements of the Plumbing License Law of 1947, Art. 6Z43-1011 Revised Civil Statutes of Texas. SECTION 13. THAT the Plumbing Code, the same appearing in Volume ll of the Code of Ordinances of the City of Lubbock, BE and the same is hereby amende by the addition thereto of the following section, to be designated Sec. 24-14. z., wh.i ~h shall read hereafter in full as follows, to-wit: Sec. 2.4-14. 2.. Same; permit and inspection fees. At the time a p~rmit is requested to make any of the installa- tions covered by the preceding section, a permit and inspection fee of $2.. 50 shall be paid to the plumbing inspector or his autho- rized representative, for each single installation. In the event a reinspection is required on any installationa an additional fee of $2. 50 shall be due prior to such reinspection.: S~CTION 14. THAT Sec_. 24-63 of the Plumbing Code, the same appearing in Vol:ume II of the Code of Ordinances of the City of Lubboc~ Texas, BE and the same is hereby amended to read hereafter in full as follows, to-wit: No arms for kitchen sinks, urinals or slop sinks shall be allowed for wastes, but shall be brought up through the floor or where a trap is used the same shall be brought up vertically or not more than a forty-five degree angle to the vertical, and directly behind the waste opening; cutting or notching more than one-half of the depth of studs or plates shall not be permitted. On all new construction at kitchen sink rough in there shall be a two inch copper or cast iron pipe with corneJ tap tee t_o accomodate sink disposal and dishwasher installation. Waste riser to be directly behind and in the center of kitchen sink. Waste fittings to be two inch in size to accomodate 2.11 x 1-1/2.11 x 1-1/ZH fitting openings. Such installation shall also include a two inch clean out. Such clean out shall run to the outside of the building except where the installation is on the front of the building or inside an interior partition wall. T HAT Sec. 24-18 of the Plumbing Code, the same appearing in Volume II of the Code of Ordinances of the City of Lubbock, Texas, BE and the same is hereby amended to read hereafter in full as follows: 11Sec. 24-18. Same--Fees for repairing paving cut. The fee charged to repair the paving cut for any excavation referred to in Sec. 24-16 of this Code shall be based on the following rate and minimum charge list: RATE AND :MINIMUM CHARGE FOR PAVING CUT REPAIR Type Paving Quadruple asphalt Brick surface Two course surface Charge per linear foot of two foot wide cut $5.00 a. 50 2.00 Minimum charge under each rate $40.00 40.00 40. 00 Charges for cuts in excess of two feet {2'011) in width will be calculated by the City Engineer. 11 SECTION 16. Any person violating any provision of this Ordinance shall upon conviction b e fined in any sum not exceeding $200. 00. SECTION 17. Should any section, paragraph, sentence, clause, phrase or word of t his ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 18. The City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law, and this ordinance shall become effective ten {10) days after second publication thereof.
