HomeMy WebLinkAboutOrdinance - 5652-1969 - Amending Zoning Ord. #1695 By Changing Sec. 16.2-3 Governing Location - 05/08/1969KJ:EW 05-08-uR OS-2:2..-<Dq ORDINANCE NO. 5652 _.....;;...:;.;;;.;:;; ___ _ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 OF THE CITY OF LUBBOCK BY CHANGING SECTION 16. 2-3 GOVERNING LOCATION OF ACCE ORY BUILDINGS; CHANGING SECTION 16.3-1 GOVERNING LOT COVERAGE OF CCESSORY BUILDINGS; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR UBLICATION. WHEREAS, the proposed change in zoning districts as hereinafter made has een duly presented to the Zoning and Planning Commission for its recommendatio hich was received by the City Council and, after due consideration~ the City Council finds that making the proposed change as hereinafter set out will be in the ublic interest; and~ WHEREAS, all conditions precedent required by law for a valid amendment to he Zoning Ordinance and Map have been fully complied with, as well~as giving otices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro ided by Article lOllfJO Vernon's Annotated Civil Statutes., amended in 1961, and otice was duly published in the Lubbock Morning Avalanche Journal more than fif- een (15) days prior to the date of the public hearing before the City Council.on sue roposed amendmentJO and the public hearing according to said notice was duly held · the City Council Room on the second floor of the City Hall., Lubbock, Texas., at hich time persons appeared in support of the proposal; and, after said hearing, it as by the City Council determined that it would be in the public :interest, due to hanged conditions .. that the Zoning Ordinance and the Zoning Map be amended in th anner hereinafter set forth in the body of this Ordinance and this Ordinance havin een introduced prior to first reading hereof; NOW THEREFORE: E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:: SECTION 1. THAT Section 16.2-3 of Zoning Ordinance No. 1695 of the City f Lubbock BE and is hereby amended to read as follows: Section 16. 2 ... 3. Not less than three (3) feet from the side lot line when not constructed.l' intended, or used for human occupancy at any time., exce for row dwelling or townhouse developments, no setback shall be required for garages or carports. SECTION 2. THAT Section 16. 3-1 of Zoning Ordinance No. 1695 of the City f Lubbock BE and is hereby amended to read as follows: Section 16.3-1. An accessory building shall occupy no more than thirty- five (35) percent of the minimum required rear yard~ except row dwelling or townhouse developments may cover all of the minimum required rear yard provided that the "overall11 lot coverage maximum of sixty (60) per- cent is not exceeded. SECTION 3. Should any section, paragraph# sentence, clause., phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publica ion of the descriptive caption of this Ordinance as an alternative method provided y law.
