ORDINANCE NO. 3223
AN ORDINANCE AMENDING ZONIOO ORDINANCE NO. 1695 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING
CHANGE: ZONE CASE NO. 862 :CHANGE LOTS 13 THROUGH 15 INCLUSIVE,
FROM A uc-3" TO A uc -4" ZONING DISTRICT AND TO CHANGE LOTS 16
THROUGH 22 INCLUSIVE FROM AN 11R-311 TO A 11C-411 ZONING DISTRICT, ALL
LOTS BEING IN BLOCK 133, OVERTON ADDITION TO THE CITY OF LUBBOCK,
LUBBOCK COUNTY, TEXAS. (SAID PROPERTY BEING LOCATED IN THE 2400
BLOCK OF 5TH STREET): SUBJECT TO CONDITIONS.
WHEREAS, the proposed change in zoning districts as hereinafter made has
been duly presented to the Zoning and Planning Commission for its recommenda-
tion, whic.h was received by the City Commission and after due consideration, the
City Commission fitids that making the proposed change as hereinafter set out will
be in the public interest; and,
WHEREAS, all conditions precedent required by law for a valid amendment to
the Zoning Ordinance and Map have been fully complied with, as well as giving
notices in compliance with Section 20 of Ordinance No. 1695 as well as notices
provided by Article 1011£, Vernon•·s Annotated Civil Statutes, amended i n 1953, an
notice was duly published in the Lubbock Morning Avalanc;:he more than fifteen {1 5l
days prior to the date of the public hearing before the City Commission on such pro
posed amendment, and the public hearing according to said notice was duly held in
the City Commission Room on the first floor of the City Hall, Lubbock, Texas, at
which time persons appeared in support of the proposal; and, after said hearing it
was by the City Commission determined that it would be in the public interest, due
to changed conditions., that the Zoning Ordinance and the Zoning Map be amended
in the manner hereinafter set forth in the body of this Ordinance and this Ordinance
having been introduced in final written form prior to first reading hereof; NOW
THEREFORE:
E IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
I SECTION 1. THAT Ordinance No. 1695 and tre Official Zoning Map BE and the
arne are hereby amended as follows, to-wit:

Change Lots 13 through 15 inclusive, from a uc .. 3u to a
uc •4" zoning district and to change Lots 16 through 22.
inclusive from an "R-311 to a "C -4" zoning district, all
lots being in Block 133, Overton Addition to the City of
Lubbock, Lubbock County, Texas. (Said property being
located in the 2400 Block of 5th Street); Subject to the
following conditions: .
(1) That no vehicular ingress or egress be permitted
from 5th Street.
(2.) That a solid, seven foot screening fence be provided
along the East side of the property, and along the South
side of the property to within 150 feet of Collese Avenue.
(3) That this property shall not be used for:
a. factory, fabricating or processing plant;
b. general storage warehouse;
c. general automotive garage;
d. new and used car sales;
e. commercial night club;
f. storage for wholesale distribution;
g. commerciallaundry;
h. building sup plies sale.J;
i. grocery stores
j. variety stores• or
k. dry goods or dept. store types.
provided, however, nothing herein ahall be construed as
forbidding any other use allowed in a 11C -311 zone; provided
further, however, nothing herein shall be construed as for-
bidding upon Lots 13 through 15, both inclusive, of this
:property any use permitted in a "C-3" zone.
l4) That the owners and/or developers shall make applica-
tion for and secure a building permit within ten months after
the date of final passage of this Ordinance.
SECTION 2. THAT from and after passage and effective date of this Ordinance
said lots, tracts and parcels of land described in Section 1, hereof shall be
changed to the zoning district indicated and the Official Map is amended in accord-
ance herewith.
AND IT IS SO ORDERED
Passed by the Commission on first reading this 28th day of July, 1960.
