HomeMy WebLinkAboutOrdinance - 5640-1969 - Ordinance Ordering That Anelection Be Held In LBK On May 6, 1969 - 04/10/1969ORDINANCE NO. 5640 AN ORDINANCE of the City Council of the City of Lubbock, Texas, ordering that an election be held in said City on the 6th day of May, 1969, for th~ purpose of submitting to the resident qualified electors of the City who own taxable property in the City and who have duly rendered the same for taxation, a proposition for the issuance of bonds of ~aid City; designating the places at which said election shall be held; appointing the officers of said election; pro- viding for notice of said election; enacting prov1s1ons incident and relating to the subject and purpose of said ordinance; and declaring an emergency. WHEREAS, the City Council of the City of Lubbock, Texas, deems it advisable and in the City's best interest that bonds of the City be authorized and issued for the purpose hereinafter stated; and, WHEREAS, the City Council has found and hereby declares there is an urgent public necessity for the acquisition and con- struction of the improvements to be provided w::_th the proceeds of said bonds at the earliest possible date for the immedate preser- vation of the public peace, property, health and safety of the citizens of the City of Lubbock, and that by virtue thereof this ordinance shall be passed and adopted as an emergency measure; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK SECTION 1: That an election be held on the 6th day of May, 1969, which date is not less than fifteen (15) nor more than thirty (30) days from the date of the adoption of this ordinance, at which election the following proposition shall be submitted to the resident qualified electors of said City, who own taxable prop- erty therein, and who have duly rendered the same for taxation: "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue TEN MILLION TWO HUNDRED THOUSAND DOLLARS ($10,200,000) revenue bonds of said City for the purpose of making permanent public improve- ments, to wit: extending and improving the City's Electric Light and Power System; said bonds to mature serially over a period of years not to exceed FORTY (40) years from their date, and to bear interest at a rate not to exceed the maximum prescribed by law at the time of issu- ance, payable annually or semi-annually; to be issued in accordance with and secured in the manner provided in Article 1111 et seq., V .A. T. C. S., each bond to be condi- tioned that the holder thereof shall never have the right to demand payment of said obligation out of funds raised or to be raised by taxation, and secured by a pledge of the net revenues from the operation of the City's Electric Light and Power System?" .. . . The Presiding Judge shall appoint at least two (2) Clerks (one of whom shall be the Alternate Presiding Judge if the election is conducted by the regularly appointed Pre- siding Judge) and not more than three ( 3 ) additional Clerks, as he deems necessary for the proper conduct of the election. ABSENTEE VOTING shall be conducted by the City Secretary at the City Hall, in accordance with the provisions of Chapter 5, V.A.T.C.S., Election Code. SECTION 3: That said election shall be held under the provisions of and in accordance with the laws governing the issu- ance of municipal bonds in cities, as provided in the General Laws of the State of Texas, and only resident qualified electors, who own taxable property in the City, and who have duly rendered the same for taxation, shall be qualified to vote. SECTION 4: That the ballots for said election shall be prepared in sufficient number and in conformity with Chapter 6, V.A.T.C.S., Election Code, and printed on such ballots shall appear the following proposition: 11THE ISSUANCE OF $10,200, 000 REVENUE BONDS FOR ELECTRIC LIGHT AND POWER SYSTEM IMPROVEMENTS AND EXTENSIONS AND PLEDGING THE REVENUES OF SAID SYSTEM TO THE PAYMENT THEREOF" The word "FOR" and beneath it the word "AGAINST" shall be made to appear to the left of the proposition. A square shall be printed on the left of each of the words "FOR" and "AGAINST", and each voter shall place an "X" in the square beside the state- ment indicating the way he wishes to vote • • ... SECTION 5: That a copy of this ordinance, signed by the Mayor of the City and attested by the City Secretary, at the top of which shall appear the words "NOTICE OF ELECTION FOR THE ISSUANCE OF BONDS", shall serve as proper notice of said election. Said notice shall be posted at the City Hall and at each of the polling places in said City, not less than fourteen (14) full days prior to the date on which said election is to be held, and be published on the same day in each of two successive weeks in the LUBBOCK AVALANCHE-JOURNAL , which is a newspaper of general circulation in and published in the City of Lubbock, Texas, the first of said publications to be made not less than £surteen (14) full days prior to the date set for said election. SECTION 6: The public importance of this measure and the fact that it is to the best interest of the City of Lubbock to provide the improvements indicated by the proposition for the issu- ance of bonds hereinabove set out at the earliest possible date for the immed~te preservation of the public peace, property, health and safety of the citizens of said City constitute and create an emergency and an urgent public necessity requiring that this ordi- nance be passed and take effect as an emergency measure, and that this ordinance is accordingly passed as an emergency measure and shall take effect and be in force immed~ately from and after its passage, and it is so ordained. NOTICE OF ELECTION FOR THE ISSUANCE OF BONDS THE STATE OF TEXAS X X COUNTY OF LUBBOCK X X CITY OF LUBBOCK X TO ALL RESIDENT QUALIFIED ELECTORS OF THE f) CITY OF LUBBOCK, TEXAS, WHO CXVN TAXABLE PROPERTY IN SAID CITY AND WHO HAVE DULY RENDERED THE SAME FOR TAXATION: TAKE NOTICE that an election will be held in the City of Lubbock, Texas, on the 6th day of May, 1969, in obedience to an ordinance duly entered by the City Council on the lOth day of April, 1969, on the proposition set forth in the attached copy of such ordinance, said ordinance being made a part of this notice for all intents and purposes. THIS NOTICE OF ELECTION is issued and given by the under- signed, pursuant to authority conferred by virtue of the attached ·ordinance of the City Council of the City of Lubbock, Texas, and under authority of law.
