ORDINANCE NO. 5632
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFI-
CIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING
CHANGE: ZONE CASE NO. 1274A: CHANGE A TRACT OF LAND OUT OF SEC-
TION 6 J BLOCK E-2, LUBBOCK COUNTY. TEXAS. FROM AN 11R-3 11 TO A 11C-411
ZONING DISTRICT; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR
PUBLICATION.
WHEREAS, the proposed change in zoning districts as hereinafter made has
been duly presented to the Zoning and Planning Commission for its recommenda-
tion, which was received by the City Council and, after due consideration, the Cit
Council finds that making the proposed change as hereinafter set out will be in the
public interest; and,
WHEREAS, all conditions precedent required by law for a valid amendment to
the Zoning Ordinance and Map have been fully complied with, as well as giving
notices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro
vided by Article 101lf, Vernon's Annotated Civil Statutes, amended in 1961, and
notice was duly published in the Lubbock Morning Avalanche Journal more than fif
teen (15) days prior to the date of the public hearing before the City Council on sue
proposed amendment, and the public hearing according to said notice was duly hel
in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at
which time persons appeared in support of the proposal; and, after said hearing,
it was by the City Council determined that it would be in the public interest, due to
changed conditions, that the Zoning Ordinance and the Zoning Map be amended in
the manner hereinafter set forth in the body of this Ordinance and this Ordinance
having been introduced prior to first reading hereof; NOW THER EFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
ZONE CASE NO. 12 74A
Change a tract of land out of Section 6, Block E ... 2, Lubbock County,
Texas, from an 11R-311 to a "C-411 Zoning District. Property is further
described by metes and bounds to-wit:
The South 37-:! feet of the following tract:
BEGINNING at a point 1320 feet South 401 East of the Northwest
corner of Section 6, Block E ... 2, for the NW corner of this tract;
THENCE East 961 .• 5 feet to the NW corner of that certain 5 acre
tract conveyed by Warranty Deed to Harry Blakei dated July 5i 1945l'
recorded in Volume 294, Page 300, Deed Records, Lubbock County,
Texas, for the NW corner of this tract;
THENCE South along the West line of said Harry Blake 5 acre
tract. 317 feet to a point;
THENCE West 961.5 feet to a point in the West line of Section 6,
Block E-2, for the SW corner of this tract;
THENCE North 317 feet to the PLACE OF BEGINNING.
SECTION 2. THAT from and after passage and effective date of this Ordi-
nance, said lots, tracts and parcels of land described in Section 1 hereof shall be
changed to the zoning district indicated and the Official Map is amended in accord-
ance herewith.
SECTION 3. Should any section, paragraph, sentence, clause, phrase, or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause publica-
tion of the descriptive caption of this Ordinance as an alternative method provided
by law.
AND IT IS SO ORDERED
