HomeMy WebLinkAboutOrdinance - 5611-1969 - Amending Zoning Ordinance #1695 And Lubbock Map For Changes: Zone Case #1130-B - 02/26/1969KJ:EW oz -2<.D -<.oq o a-ta-(.oq ORDINANCE NO. 5611 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFI- CIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 1130-B: CHANGE LOTS 6 THRU 10, HALBERT ADDITION, AND THE UNPLATTED TRACT OF LAND BETWEEN THE WEST LIN OF LOT 6 AND AVENUES., CITY OF LUBBOCK, LUBBOCK COUNTY,. TEXAS, FROM AN 11R ... 211 TO AN 11A-2" ZONING DISTRICT; SUBJECT TO CONDITIONS; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommenda- tion, which was received by the City Council and, after due consideration, the City Council finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro vided by Article lOllf, Vernon's Annotated Civil Statutes~ amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal more than fif- teen (15) days prior to the date of the public hearing before the City Council on sue proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, i was by the City Council determined that it would be in the public interest, due tp changed conditions, that the Zoning Ordinance and the Zoning Map be amended in he manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and he same are hereby amended as follows, to-wit: ZONE CASE NO. 1139-B Change Lots 6 thru 10, Halbert Addition, and the unplatted tract of land betwee the West line of Lot 6 and Avenue S,. extending 131.75 feet South of 48th Street, City of Lubbock., Lubbock County, Texas~ from an ttR-2 11 to an "A-211 Zoning District. SUBJECT TO THE FOLLOWING CONDITIONS: Development of the above described property shan: be limited to apartments only. SECTION 2. THAT from and after passage and effective date of this Ordinanc , aid lots 1 tracts and parcels of land described in Section 1 hereof shall be changed o the zoning district indicated and the Official Map is amended in accordance , ere with. - SECTION 3. Should any section, paragraph, sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason. the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publica ion of the descriptive caption of this Ordinance as an alternative method provided y law.
