ORDINANCE NO. 5609
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFI-
IAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING
RANGE: ZONE CASE NO. 1589: CHANGE A TRACT OF LAND OUT OF SECTIO
2, BLOCK E-2, LUBBOCK COUNTY, TEXAS, FROM AN 11R ... l" TO AN "R-2"
ONING DISTRICT; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUB-
ICATION.
WHEREAS, the proposed change in zoning districts as hereinafter made has
~n duly presented to the Zoning and Planning Commission for its recommenda-
ion, which was received by the City Council and, after due consideration, the
ity Council finds that making the proposed change as hereinafter set out will be in
he public interest; and,
WHEREAS, all conditions precedent required by law for a valid amendment to
he Zoning Ordinance and Map have been fully complied with, as well as giving
otices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro-
ided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and
otice was duly published in the Lubbock Morning Avalanche Journal more than fif-
een (15) days prior to the date of the public hearing before the City Council on sue
reposed amendment, and the public hearing according to said notice was duly held
n the City Council Room on the second floor of the City Hall, Lubbock, Texas, at
hich time persons appeared in support of the proposal; and, after said hearing, it
as by the City Council determined that it would be in the public interest, due to
hanged conditions, that the Zoning Ordinance and the Zoning Map be amended in th
anner hereinafter set forth in the body of this Ordinance and this Ordinance havin
een introduced prior to first reading hereof; NOW THEREFORE:
E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and
he same are hereby amended as follows, to ... wit:
ZONE CASE NO. 1589
Change a tract of land out of Section 12, Block E-2, Lubbock County,
Texas, from an "R-1'' to an "R-211 Zoning District. Property is
further described by metes and bounds to-wit:
BEGINN1NG at a point in the East line of Indiana Avenue that is 55. 0'
East and 1042. 0' North of the S. W. corner of Section 12, Block E-2
for the S. W. corner of the tract herein described;
THENCE N. along the E. line of Indiana Avenue 235.01 to a point;
THENCE AROUND THE ARC OF A CURVE TO THE RIGHT OF RADIUS
15. 0' a distance of 23, 56 1 to a point;
THENCE E. along a: line 550. 0' to a point;
THENCE around the arc of a curve to the right of radius 15. o!,
23. 56' to a point;
THENCE S. 235. 0' to a point;
THEN::!E W. 580. 0' to the place of BEGINNING~ contc:ti.ning 3. 327 acres
SECTION 2. THAT from and after passage and effective date of this Ordi-
nance, said lots, tracts and parcels of land described in Section 1 hereof shall be
changed to the zoning district indicated and the Official Map is amended in accord-
ance herewith.
SECTION 3. Should any section, paragraph, sentence, clause, phrase, or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause publica-
tion of the descriptive caption of this Ordinance as an alternative method provided
by law.
