'\ \ U·~ ),-l ... ·:i~? \; if ORDINANCE NO. 1237 0=J. -l o -19 S.;;.2_,,....---.~--AN ORDINANCE GRANTING THE PANHANDLE AND SANTA FE RAIL-WAY COMPANY~ A CORPORATION, ITS ASSIGNEES, SUCCESSORS AND LESSEES, THE RIGHT, POWER AND PRIVILEGE OF LOCATING, BUILDING~ ERECTING, CONSTRUCTING AND PROPERLY MAINTAINING A SPUR \::-:; .. .t~, 7'1 f1,J/ t,,I.L;_z. r 0 u 7,t'~ !l/SF~(( c ~ TRACK AND TO OPERATE ENGINES, CARS AND TRAINS THEREON, UPON AND ACROSS AN ALLEY IN BLOCK TWO {Z), RATLIFF ADDITION TO THE CITY OF LUBBOCK, AS SHOWN BY EXHIBIT "A" ATTACHED TO SAID ORDINANCE, THAT PART OF SAID SPUR TO BE LOCATED IN SAID ALLEY BEING SHOWN BY A YELLOW LINE ON SAID EXHIBIT "A"; PROVIDING CON-DITIONS UNDER WHICH SUCH GRANT IS MADE. . _ BE IT ORDAINED BY THE CITY COMM15SION OF THE CITY OF LUBBOCK: SECTION 1. THAT the Panhandle and Santa Fe Railway Company, a corporation, and its assignees, successors and lessees BE. and they are hereby granted the right, power and privilege of locating, building, erecting, constructing and properly maintaining a railroad spur track, and to operate engines, cars and trains thereon and across the alley in Block Two (2), Ratliff Addition to the City of Lubbock, as said spur track is indicated by a yellow line on Exhibit "A" attached hereto and designated 110. E. 0. Slaton, Texas, No. 4326, 11 dated April 9, 1952. SECTION 2. That said Railroad is hereby required and by the acceptance of this Ordinance agrees that it will construct, maintain and operate said spur track so as to conform to the grade now existing or which may hereafter be established by the City Engineer of the City of Lubbock for said street and alley, and in such manner as to interfere as little as possible with the use and enjoy-ment, ingress and egress of the abutting' premises by the owners and other lawful occupants thereof, will pay the cost of paving space occupied by the said track, or damage done by reason of the construction of said track, and will maintain and operate said track at such alley location, together with the other equipment incident thereto in accordance with the laws of the State of Texas and lawful ordinances and resolutions of the City of Lubbock in such cases made and provided. SECTION 3. It is understood that the City of Lubbock shall not be liable to any person for damages done or property taken on account d this grant, and that said Railroad shall reimburse the City of Lubbock and save it harm-less from all claims arising on account of this grant.
