WHEREAS, the City Commission has heretofore accepted a proposal sub-
mitted by N. R. Cogburn and wife, Artie Cogburn, owners of certain land to be
acquired and used in the extension of 34th Street east of Avenue H, and Neil
DeLavan, lessee of said land, as recorded in Book 11, page 103 -105, Minute Recor
of the City of Lubbock, whereb,y the City Commission has agreed to pay the required
sum of Eight Thousand Eight Hundred and No/100 ($8,800.00) Dollars as set forth
in said Proposal; and,

vffiEREAS, the estimated cost of the relocation of improvements situated
on said land as set forth in said proposal and acceptance is estimated to be
Twenty-Three Thousand Four Hundred Fifty and No/100 ($23,450.00) Dollars; and,
WHEREAS, the City Commission is of the opinion that an allotment
should be ma.de out of available bond funds to be used in furtherance of the contrac
to acquire said right of way; NOW, 'TIIEREFORE,
BE IT ORDAINED BY THE CITY COMHISSION OF THE CITY OF LUBBOCK:
SEX::TION 1. That Thirty-Two Thousand Two Hundred Fifty and No/100
($32,250.00) Dollars from available l1'ight-.of-t.'Tay bond funds is hereby set aside
to be used in the proper administration of the contract set forth in the preamble
to this Ordinance, said funds not to be commingled.
SEX::TION 2. The amount of Forty-Eight Hundred and No/100 (~4800.00)
Dollars of the fund set aside in Section 1 (One) of this Ordinance shall be paid
toN. R. Cogburn and wife, Artie Cogburn, upon delivery of. a warranty deed to
the land to be conveyed by them to the City as set forth in said contract,
Eighteen Hundred and No/100 ($1800.00) Dollars of the Forty-Eight Hundred and No/1
($4800.00) Dollars representin~ loss of rentals during the period of transition,
and Three Thousand and No/100 {$3000.00) Dollars of said amount representing the
cost of refinishing the interior of all buildings required to be moved under said
contract.
Four Thousand and No/100 ($4,000.00) Dollars of the fund set aside
in Section 1 (One) of this Ordinance is hereby designated and shall be paid to
Neil DeLavan upon delivery of a fUll and final release of all damages resulting
from the extension and opening of 34th Street through said land as set forth in
said proposal.
The balance of Twenty-Three Thousand Four Hundred Fifty and No/100
{$23,450.00) Dollars of the fund set aside in Section 1 (One) of this Ordinance
shall be used to complete the contract to be hereinafter entered into to carry
forth the terms and conditions agreed upon by the City of Lubbock in said proposal
and acceptance as recorded in Book 11, page 103 -105, Minute Records of the
City Commission of the City of Lubbock, Texas.
SEXJTION J. The fact that readily available moneys t-rill be necessary
to the proper preformance of the conditions and agreements set forth in said
contract referred to in Section 2 (Two) of this Ordinance creates an emergenqr,
and this Ordinance shall become effective from and after its passage.
