AN ORDINANCE ESTABLISHING THE 11SOUTHEAST LUBBOCK DEVELOP
MENT BOARD;" DEFINING AND DESIGNATING THE TERM OF OFFICE OF
ITS MEMBERS; PROVIDING FOR THEIR SUCCESSORS; VESTING SAID BOARD
WITH POWER TO INVESTIGATE AND MAKE RECOMMENDATIONS TO THE
CITY COMMISSION AS DIRECTED BY IT~ RELATING TO PERMANENT
IMPROVEMENTS IN SOUTHEAST LUBB.OCK; PROVIDING EX OFFICIO MEM-
BERS; AND STATING THE PURPOSE OF THE BOARD.
WHEREAS, the City Commission has for some tiine recognized the need
of an ordeily development of an area in Southeast Lpbbock known as the City•s
100-Acre Tract~ lying immediately north of the City Cemetery, and which is
not needed for other City purposes, and deems it expedient and in the public
interest to establish a board for the purpose of recommending ways and means
for the development of said area consistent with proper street alignment, public
utility systems, drainage and desirable health conditions• THEREFORE,
BE IT .ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. There is hereby created and established a board to be known
as the "SOUTHEAST LUBBOCK DEVELOPMENT BOARD, 11 to be composed of
twelve (12) members, each of whom shall be resident citizens of the City of
Lubbock. The members of said Board shall be appointed by the City Commis-
sion of the City of Lubbock and shall hold their office for a term of three (3)
years. EXCEPT that four (4) of the members first selected shall hold office for
terms of one·(l) year, four (4) members shall hold office for the terms of two
(2) years, and four (4) members shall hold office for the terms of three (3) year ,
the te:tm of each to be determined by loti and thereafter their successors shall
hold office for three (3) years and until their successors are appointed.
SECTION 2. STATEMENT OF POLICY. The City Commission in making
appointments will endeavor to make all appointments to said Board so that at
all times there will be at least three {3) members from the Real Estate Board
of Lubbock and three (3) members of the Negro race.
SECTION 3 •. Upon the death, resignation, removal or expiration of the
term of office of any of the members of said Board, the City Commission shall
nominate and appoint a successor as a member of said Board, who shall hold
his membership on said Board for the unexpirad term of the member he is
appointed to succeed, or for the period of three (3) years .when the appointment
is made due to the expiration of a Board member t s term; and further provided
that in the event the best interests of the City of Lubbock require the removal
of any member of said Board, removal of such member shall be effected
through appointment of such memberts successor by unanimous vote of the City
Commission.
SECTION 4. No salary or compensation of any kind shall be paid to the
members of the Southeast Lubbock Development Board for their services as
Board members.

SECTION 5. When the City Commission of the City of Lubbock has
appointed the twelve (12.) members of said Board, as soon thereafter as is
practicable, said members shall meet and organize and shall appoint one of
its members as Chairman, and one of its members as Secretaryi and it shall
be the duty of the Chairman to preside at all meetings of the Board, and said
Chairman shall not vote on any matter before the Board except in the event of
a tie vote; and the Secretary of said Board shall keep a record of all the pro-
ceedings of said Board which shall, upon request of the City Commission, be
delivered to it for inspection and review.
SECTION 6. Any and all recommendations made by said Board to the
City Commission shall be by the concurring vote of six (6) members of the
Board, provided, however, this provision shall not exclude a minority recom-
mendation, which is hereby authorized to be made in writing, by less than a
majority of the members of said Board; and a majority of the total membership
of said Board shall constitute a quorum for the transaction of all matters to be
considered by said Board, provided further all members shall have adequate
notice of each Board meeting.
SECTION 7. The Southeast Lubbock Development Board hereby created
is and shall constitute an advisory board to 1he City Commission of the City of
Lubbock with authority to bold hearings in Lubbock and to consider and make
recommendations to the City Commission in writing from time to time on any
and all matters referred to it by the City Commission; it being contemplated
that the Board members shall form a corporation for the purpose of selling to
members of the Negro race homes and/or lots on which homes are to be con-
structed, all in substantial compliance with letter addressed to the Hon. Murrell
R. Tripp, Mayor, and signed by 0. S. Cates, president of the Lubbock Real
Estate Board, and dated August 9, 1952., and further provided that the by-laws,
rules and recommendations of the proposed corporation shall be submitted to
the City Commission for approval.
SECTION 8. The following officers of the City of Lubbock shall be ex
officio members of said Board without voting privileges, and shall act only
in an advisory capacity to said Board: The City Manager, and the Planning
Engineer.
SECTION 9. The provisions of this Ordinance shall never be construed
as constituting an agreement between the City and said Boa.;rd or its members
or any corporation or other entity to sell all or any part of any property
I belonging to the City of Lubbock to any such persons, it being strictly under~
stood that any agreements between the City and the proposed corporation Of
other persons shall be hereafter made by separate written agreement between
the City and said corporation under such terms and conditions as may be
mutually agreed upon.
The fact that there is an immediate need for study a1.d consideration of
matters involving development in Southeast Lubbock relating directly to the
extension of health facilities and many other improvements of a public nature
creates an emergency and a necessity for suspending all rules that ordinances
be read on several days, and said rules are hereby suspended and this ordinance

shall become effective upon its reading and passage.
AND IT IS SO ORDERED.

In response to your recent request for a suggestion to the problem you
have with the expanding and increasing colored section of Lubbock, a
committee was appointed and have made a recommendation. This recom•
mendation was brought to the Board of Directors and approved. It was
then submitted to the entire Board and unanimously approved. The
recommendation is~ as follows:

The Board recommends that an organization be set up for the development
of the 100 acres belonging to the City for the colored people with a
shopping center set aside and made a part of the development. The
organization would be similar to the Cemetery Association and would be
managed and/or directed by a twelve man Board of Directors. These
D.irect~L!i~e,o'lot to receive any compensation for their duties. They are
to be ~r"''i'!a by the 1lity Commission. The Board recommends that the
twelve man Directors be made up of three men furnished by the city, three
men furnished by the civic clubs of LUbbock and three from the Real Estate
Board, and three men from the colored section. These men would have
their terms arranged in such a W113' that one-third of the Directors will
be changed each year.
Due to the very nature and intent of this subdivision~ the sale of the
lots should be made directly from the Association to the colored home
owner. The contract of sale or deed should require that the purchaser
build a home on it within a specified time and to meet the restrictions
that have been placed on the subdivision. A'r'q contractors who secure ;
contracts for construction of homes in this subdivision are not to receive
title to the lots concerned.
It is also recommended that since the shopping center ~11 be a very
attractive investment, all of the lots therein should be leased on a

The Board also recommends that the twelve man Board of Directors should
give consideration and make recommendations concerning problems in aqy
other colored district where development is undertaken.
The Lubbock Real Estate Board appreciates your coming to us with this
