AND MODIFYING PROVISIONS OF ORDINANCE NO. 1Z41 (/ _ INSOFAR As ANY SUCH PROVISION OF SAID .ORDINANCE IS AFFECTED BY L u.J. THIS AMENDMENT; ESTABLISHING AN EFFECTIVE DATE; DEClARING AN 't;:~u~( EMERGENCY. WHEREAS, the contract with Texas Technological College has expired, and said institution has constructed at its own :expense water mains to serve its entire water system, including the furnishing of meters and all necessary equipment, and, / WHEREAS, it has been determined by the Department of Public Works that the cost of ownership of water distribution mainJJ, meters, etc. is approxi- mately three cents {3¢) per 1, 000 gallons of water delivered to the customer, and, WHEREAS, the Commission finds that the immediate passage of this ordinance is imperative in connection with the daily operation of the Water Department and creates an emergency requiring the suspension of all rules with reference to the reading of ordinances on more than one day; THEREFORE, BE IT -oRDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. That from and after the passage and effective date as pro- vided for herein, Section 5 of Ordinance No. 1Z41 is hereby amended to read as follows: "SECTION 5. The rates established in Section 1 of this Rate Ordinance shall be applicable to water conswned by Texas Technological College, PROVIDED• HOWEVER, that the rate for each 1, 000 gallons of water per month in excess of one million (11 000, 000) gallons of water per month shall be fifteen cents {15¢) per 1, 000 gallons, AND IT IS FURTHER PROVIDED that all meters used for measuring water consumed on the Texas Technological College campus grounds shall be totalled and the college billed as if all water consumed passed through one (1} meter." SECTION z. The rates established by this ordinance shall be effective to July, 195Z water consumption at Texas Technological College Campus on August, 195Z billing, and shall remain in effect until duly changed by ordinance. SECTION 3. The provisions of this ordinance shall not be construed as in any manner changing, amending or otherwise modifying any water rates established by Ordinance No. 1Z41 except as herein expressly provided for _. 0 rates to Texas Technological College. SECTION 4. The fact tQ.a.t the establishment of water rates for Texas Technological College relates to the daily operation of the Water Department. creates an emergency requiring the suspension of all rules pertaining to the passage of ordinances on more than one readingJ and the same are hereby suspended for the preservation of public health an:d property. and this ordinance shall become effective upon its passage and the rates applied according to the provisions of Section z. AND IT IS SO ORDERED.
