AN ORDINANCE ESTABLISHING BUILDING AND RIGHT-OF-WAY
LINES ON THE NORTH AND SOUTH SIDES OF 38TH STREET BETWEEN
AVENUE ttQn AND AVENUE nsn; PROVIDING FOR SETBACKS ACCORDING
TO ZONING ORDINANCE NO. 661; PROVIDING THAT NO BUILDING OR
OTHER STRUCTURE SHALL BE REPAIRED OR PLACED BETWEEN THE
BUILDING LINES EXCEPTING PUBLIC UTIUTIES ON PUBLIC PROPERTY
BETWEEN BUILDING LINES; REQUIRING THAT STRUCTURES CONFORM TO
SUCH BUILDING LINES AND SETBACK PROVISIONS OF ORDINANCE NO. 661
AS AMENDED, WITHIN FIVE (5) YEARS; DEFINING "BUILDING LINE11i AND
AUTHORIZING PUBLICATION OF THE CAPTION OF THIS ORDINANCE.
WHEREAS, the Governing Body finds that public convenience, safety and
necessity in the City of Lubbock require that building lines or right-of-way lines
be estabij.shed on 38th Street between Avenues Q and S so as ultimately a street
required in the public interest to open, extend, widen and otherwise improve the
same, will be secured, and the present width at the location mentioned is inade-
quate to meet requirements for street purposes; and the Governing Body further
finds that the establishment of such lines at this time will promote economy in
the extension and widening of such streets; THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. That public necessity, convenience and safety in the City of
Lubbock require the extension, opening, widening, construction and improve-
ment of that part of the street hereinafter designated, within the building lines
herein established.
SECTION z. A building or right-of-way line is hereby established on that
part of 38th Street extending between Avenue Q and AvenueS as follows:
NORTH SIDE: Beginning at a point in the West property line of
Avenue Q, said point being 1, 345 feet North and 751.7 feet West
of the Southeast corner of the Northeast One-Quarter (NE 1/4),
Survey Ten {10), Block B, County of Lubbock, Texas; THENCE
West parallel to and fifty (50) feet distance North from the now
existing South property line of 38th Street to a point in the East
property line of Avenue R; THENCE continuing West from a
point in the West property line of Avenue R parallel to and fifty
(50} feet distance North from the now existing South property
line of 38th Street to a point m the East property line of Avenue S.
SECTION 3. The right-of-way line or building line now existing on the
South side of 38th Street between Avenue Q and AvenueS shall remain the same
and is recognized, designated and established as being the North property line
of Lots One (1) to Eight {8), inclusive, in Block One {1), Southport Addition to
the City of Lubbock.
SECTION 4. The term "building line" as used herein shall be construed
to mean "street right-of-way line, 11 and the setback requirements under Zoning
Ordinance .No. 661 shall apply in addition to the right-of-way lines, or building
lines, herein established, it being the intent and purpose of this Ordinance to •

preserve all land within the building lines herein established for ultimate
street purposes.
SECTION 5. That no building or other structure shall be erected, re-
erected, or substantially repaired, and no new structures or parts thereof
shall be erected or re-erected on that part of the street herein designated
within said lines herein established.
SECTIQN 6. That all structures now exten~iing or being located within or
between said building lines herein established are hereby required to conform
to the lines herein established within five (5) years from the effective date of
this Ordinance.
SECTION 7. That the prov1s1ons of this Ordinance prohibiting the placing
of structures between the building lines herein established shall not apply to any
officer, agent, employee or other person duly authorized by the City of Lubbock,
when such work relates to utility extensions or street ilnprovements, PROVI-
DED this provision shall not be construed as authorizing any such persons to
enter upon private property lying between such lines until the same bas been
dedicated to public use or otherwise acquired for such purpose.
SECTION 8. The City Secretary is hereby directed to cause publication
of the descriptive caption of this Ordinance.
AND IT IS SO ORDERED.
On motion of Commissioner Thomas , seconded by Commis-
sioner Carpenter 1 the forego1ng ordinance was passed on first
reading by the following vote of the City Commission on the 24th day of
, July 1 1952:
Commissioners voting "YEA": Morris, Carpenter, Thomas and Mayor Tripp
Commissioners voting "NAY": None
On motion of Commissioner Thomas 1 seconded by Commis-
sioner Carpenter , the foregoing ad.inance was passed on
second reading by the following vote of the City Commission on the 14th day
of Aupust , 1952:
Commissioners voting "YEA": Morris, Carpenter, Davis, Thomas and
