J l-+... l QS..;2J AN ORDINANCE DECLARING THE BUILDIID OF FIRES AND BURNING OF TRASH, DEBRIS AND OI'HER COF1ffiUSTIBLE MATERIAlS WITHIN THE CITY OF LUBBOCK IN SUCH A MANNER THAT OFFENSIVE SMOKE, ODORS, SOOT OR ASH FALLS OR IS BLOWN INTO AND ACROSS StmROU.NDING PROPERTY AND BUILDINGS TO BE A NUISANCE; DECLARING IT TO BE UNLAWFUL FOR ANY PER• SON TO IGNITE .AND BURN TRASH, DEBRIS, OR OTHER COMBUSTIBLE MATERIALS UPON ANY PREMISES IN THE CITY OF LUBBOCK IN SUCH A MANNER THAT ENDANGERS ANY PROPERTY OR BUILDIN'GS; AND PROVIDING A PENALTY. WHEREAS, the indiscriminate burning of trash and other combustible materials upon open premises ~~thin the limits of the City of Lubbock constitutes a condi- tion detrimental to the health, safety, morals and general welfare of the people and constitutes a hazard to surro,mding property; and, WHEREAS, there is no adequate valid ordinance covering this subject, THEREFORE, BE IT ORDAINED BY THE CITY COMr.«SSION OF THE CITY OF LUBBOCK: SECTION 1. The building of fires and burning of trash, debris and other combustible materials within the limits of the City of Lubbock in such a manner that any offensive smoke, odors, soot or ash falls or is blown into and across surrounding property and buildings, shall constitute a nuisance; aDd, aey person who shall knowingly ignite and burn, or knowingly cause to be ignited and burned, or knowingly permits any person to ignite and burn any trash, debris or other com- bustible materials in such a manner that any offensive odors, smoke, soot or ash therefrom falls upon or blows into and across surrounding property and buildings shall, upon conviction, be fined in any sum not exceeding Two Hundred and N0/100 I ($200.00) Dollars, S~TION 2. It shall be unlawful for any person to knowingly ignite and burn,j or knowingly cause to be ignited and burned, any trash, debris or other combus- tible materials u:pon any premises within the limits of the City of Lubbock in such a marmer that endangers any property or buildings, and any person violating the provisions of this section shall, u.pon conviction, be fined in any sum not exceed- ing Two Hundred and N0/100 ($200,00) Dollars.
