HomeMy WebLinkAboutOrdinance - 5592-1969 - Amending Zoning Ordinance #1695 And Lubbock Map For Change: Zone Case #1572 - 01/06/196901-0q-<.qq OI-Z3--<..t>Cj ORDINANCE NO.~ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFI- CIAL MAP OF THE CITY OF LUBBOCK SO AB TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 1572: CHANGE LOTS 283 THRU 290 AND TRACT G LSillRE PARK ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS; TRACT OF LAND OUT OF SECTION 2 ~ BLOCK A, LUBBOCK COUNTY. TEXAS ROM PRESENT TO THE "C-411 ZONING DISTRICT; SUBJECT TO CONDITIONS; ROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed change in zoning districts as hereinafter made has een duly presented to the Zoning and Planning Commission for its recommendatio , hich was received by the City Council and after due consideration, the City Coun- cil finds that making ·!'he proposed change as hereinafter set out will be in the publi · terest; and, WHEREAS·, all conditions precedent required by law for a valid amendment to he Zoning Ordinance and Map have been fully complied with.. as well as giving otices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro ·ded by Article lOllf .. Vernon1s Annotated Civil statutes, amended in 1961, and otice was duly jrublished in the Lubbock Morning Avalanche Journal more than fif een (15) days prior to the date of the public hearing before the City Council on sue proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock .. Texas, at which time persons appeared in support of the proposal; and.. after said hearing, was by the City Council determined that it would be in the public interest, due to changed conditions 1 that the Zoning Ordinance and tm Zoning Map be amended in he manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and he same are hereby amended as follows, to-wit: ZONE CASE NO. 1572 Change Lots 283 thru 290 and Tract G, Wilshire Park Addition, City of Lubbock, Lubbock County, Texas; a tract of land out of Section 2, Block A, Lubbock County, Texas, from present to the "C-4" Zoning District. The unplatted tract of land out of Section 21 Block A is further descx:ibed to ... wit: BEGINNING at a point which bears 1977. 95 feet north and 1345 feet west of the Southeast corner of Section 2, Block A; THENCE South 320.45 feet; THENCE West 251.75 feet; THENCE North 320.45 feet; THENCE East 251. 75 feet to the PLACE OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITIONS: 1. That a minimum 60' building setback line be observed from Cherry Avenue or in the alternative, a solid 61 permanent type screening fence shall be erected and permanently maintained along the East Property Line> abutting Cherry A venue. 2. The following minimum parking ratios for off street parking shall be provided in accordance with the use made of the property: Apartments: Studio Unit-1 space 1 Bedroom -l! spaces 2 Bedroom - 2 spaces Churches: 1 space for each 4 seats in the auditorium. Convalescent Homes: 2 spaces for each bed Hospitals: 2 spaces for each bed Offices: 1 space for each 200 square feet of total floor space Retail Shops/Service Shops/Studios: 1 space for each 150 square feet of total floor space Restaurants: 1 space for each 100 square feet of total floor space Motels/Hotels: 1 space for each room plus spare as required for public meeting rooms Public Assembly: 1 space for each 5 seats in the auditorium or 1 space for each 200 square feet of total floor space. Bowling Alley: 4 spaces for each lane. Wholesale and Manufacturing: 1 space for each 1, 000 square feet of total floor space. SECTION 2. THAT from and after passage and effective date of this Ordi- - 2 - nance said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the Zoning District indicated and the Official Map is amended in accordance herewith. SECTION 3. Should any section, paragraph, sentence, clause, phrase, or wor d of this Ordinance be declar ed unconstitutional or invalid for any reason, the remainaer of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
