A BUILDING LINE THIRTY {30) FEET NORTH OF THE CENTER LINE OF 45TH STREE.T BETWEEN AVENUE P AND A VENUE Q; PROVIDING THAT SETBACK LINES UNDER ORDINANCE NO. 661 SHALL BE MEASURED FROM THE BUILDING LINES HEREIN ESTABLISHED; PROHmiTING THE CONSTRUCTION OR PLACING OF STRUC- TURES BETWEEN CENTER LINE OF SAID STREETS AND THE BUILDING LINES HERE ESTABLISHED EXCEPTING AUTHORIZED PERSONS; REQUIRIN REMOVAL OF STRUCTURES IN AFFECTED AREA WITHIN 5 YEARS; AND DIRECTING PUBUCATION OF THIS CAPTION. WHEREAS, the governing body finds that public convenience, safety and necessity require that building lines be established on Avenue P between 44th Street and 45th Street, and on 45th Street between Avenue P and Avenue Q, to prevent the repair and placement of structures in the area ultimately to be required for right-of-way purposes in the public interest to extend, open, widen and otherwise improve said streets, and the governing body finds that establishment of such lines will promote economy in &ch extension and widen- ing; THEREFORE. BE. IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. That public n~cessity, convenience and safety require the extension, opening, widening, construction and improvement of that part of the streets hereinafter designated. SECTION 2.., That a building line is hereby established thirty (30) feet East of the center line of Avenue P between 44th Street and 45th Street11 SECTION 3. A building line is hereby established thirty (30) feet North of the center of 45th Street between Avenue P and Avenue Q,. SECTION 4,. The term 11building line11 as used herein shall be con- strued to mean the proposed street right-of-way line on that part of the street designated~ and the setback requireme.nts under Zoning Ordinance No. 661 shall apply and be measured from the "building lines" herein established, it being the intent and purpose of this ordinance to preserve the land between the center of the street and the building lines herein established for ultimate street purposes~ r SECT ION 5. That no building or other structure shall be erected, re-erected or substantially repaired, and no new structures or parts thereof shall be erected or re-erected on that part of the property lying between the c.enter of the respective streets and the building lines herein established. SECTION 6,. That all structures now extending into or being located within or ~een the center line of said streets and the building lines herein established are hereby requi:red to conform to the lines herein established within 5 years from the effective date of this ordinance. . SECTION 7. That the provisions of this ordinance prohibiting the placing of structures between the center line of the streets affected and the building lines herein established, shall not apply to any officer, agent, or employee of the City of Lubbock, or other person duly authorized ;! J .! when such \'"lork relates to utility extensions or street inlprovements, PROVIDED this provision shall not be construed as authorizing any such persons to enter upon private property lying between such building lines and the center line of the streets, until the same has been dedicated to public use or otherwise acquired for such purpose. SECTION s. The City Secretary is hereby directed to cause publica- tion of the descriptive caption of this ordinance. AND IT l5 SO ORDERED.
