HomeMy WebLinkAboutOrdinance - 1171-1951 - Authorizing Temporary Extensions Of Water And Sewer Lines - 12/19/1951v 12-19-1951 ORDINANCE NO. 1171 AN ORDINANCE AUTHORIZING TEMPORARY EXTENSIONS OF WATER AND SEWER LINES INTO CERTAIN SPECIFIED AREAS PREVIOUSLY IMPROVED IN CERTAIN 11 LAKE AREAS;'' SUSPENDING THE OPERATION OF THAT PART OF POLICIES• RESOLUTIONS AND ORDINANCES IN CONFLICT HEREWITH; DECLARING AN EMERGENCY IN THE INTEREST OF HEALTH, SAFETY AND PUBLIC WELFARE; AND PROVIDING EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Commission heretofore established the policy of refraining from making street improvements and extending water lines, sewer lines, street paving and other utilities in 11lake areas, 11 as defined and establishe under the provisions of Ordinance No. 1096 as amended by Ordinance No. 1153 and a:; shown by previous minutes of the City Commission, and, WHEREAS, it has been found that in two of the 11lake areas11 certain tracts of land have for many years been platted and improved and used for living quarters, and the inhabitants of these particular areas are using septic tanks and cesspools as a means of sewage disposal, and, WHEREAS, it has been determined that these septic tanks and cesspools are inadequate for the purpose intended and present a serious health hazard to the areas involved and to the surrounding inhabited areas, and the inhabitants are anxious that the City correct this condition by installing sanitary sewers and water service to the areas, and the City Commission is of the opinion and finds that immediate action is required and the lines should be extended imme- diately for such continued temporary uses as the circumstances demand, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. That the. City Engineer BE, and he is hereby authorized to extend sanitary sewer service to the following described property, to-wit: (a) Block Two (2), Southview Subdivision, B. C. Wells Subdivision, Stewart Saylor Subdivision, and Lot One {1) of the Wolverton Subdivision, all located on the North and East sides of the "lake area" located at 42d Street and Avenue W (reference is made to Engineering Department Drawing File No. 3-0-10),. (It is Wlderstood that the above described properties are now served with City water,.) SECTION z. That the City Engineer BE, and he is hereby authorized to extend water and sewer lines to serve houses located below the estimated high- water level on the Northwest corner and the Southwest corner of the "lake area" located at 50th Street and Avenue A, reference being here m.ade to the Engineer- intg Department's Drawing File No. 5-0-3. SECTION 3. It is the intention of this ordinance to authorize the extension of water and sewer service to the areas described herein which have been improved by the construction of residences and other structures, and this -=--.--=~~----------------------------------------------------------------~= ordinance shall not be construed as authoriz.ing the g:-anting of building permits for new construction or the extension of water or sewer lines to other than existing structures on the properties described in Sections 1 (One) and Z. (Two) of this ordinance, and shall not be construed to authorize the construction of paving or other utilities below the estimated high-water lines except as herein expressly provided .. SECTION 4. That part of the provisions of any policy, resolution or ordinance conflicting with the provisions of this ordinance authorizing the extension of water and sewer lines as herein specially described, are hereby suspended. SECTION 5. In view of the extreme concern that conditions that now exist in 1he areas described herein might possibly be the cause of poliomyelitis, it is deemed urgent that this health hazard be eliminated immediately in the interest of public health, and an emergency b.eing thereby created, all rules relating to the passage of ordinances on more than one reading are hereby waived, and the provisions of this ordinance shall become effective upon first reading .. AND IT IS SO ORDERED.
