HomeMy WebLinkAboutOrdinance - 0977-1950 - Establishing Building Lines On US HWY Via E 19Th St. - 02_25_1950I ':~--==~-~-.;----==--=--=-====--=-==-==-~ 02-26"-\.95C) o~-o~-.9=:c> ORDINANCE NO. 977 AN ORDINANCE ESTABLISHING BUILDING LINES ON U. s, HIGHWAY, VIA EAST 19TH STREET ON THE NORTH SIDE, FROM A POINT BEING NORTH 39 511 WEST ALONG A LINE 132 FEET FROM THE IN!'ERSECTION OF THE SOUTH LINE OF SECTION 3, BLOCK ttort WITH THE RIGHT•OF-WAY LINE OF THE PANHANDLE & SANTA FE RAILWAY CO?.!PANY, WHICH IS 50 FEET 1!:ts FROM THE MAIN LINE OF THE PANHANDLE & SANTA FE RAILWAY COMPANY EASTWARD TO THE I ,J_; EASTERN CITY LIMITS THAT EX'l'END TO EAST PRESENT LINE OF VANDA AVENUE: AND ON THE '.A v't/_J ~ SOUTH SIDE OF 19TH STREET FROM A POINT 42 FEET NORTH AND 1.327 FEET WEST OF THE -fJtJA{.t{ SOUTHEAST CORNER OF SECTION .3, BLOCK 11 0"; EASTWARD TO THE EAST PROPERTY LINE OF .J:'.... j.£ VANDA AVENUE, IN ACCORDANCE WITH A COMPREHENSIVE PLAN TO IMPROVE CERTAIN STREETS ;;?--vt.--'111 AND HIGHWAYS IN THE CITY OF WBBOCK IN COXTUNCTIOli WITH THE STATE OF TEnS, THE ~ STATE HIGHWAY COMMISSION, PROHIBITING PLACING OF BUILDINGS AND STRUCTUP~S OR ~ I"' REPAIRS OF RECONSTRUCTION BETWEEN SAID LINES, ESTABLISHING TIME AND CONFORMANCE, C/t ~ AND PROVIDING PENALTIES FOR VIOLATION. £ ]t.. -1.. )J WHEREAS, the proj eoted plans necessitate the opening of streets in the ] , ~, vicinity hereinaf'ter described for the purpose ot linking portions of streets 11 J"'V now in existence rlth those to be opened, extended and constructed, and, WHEREAS, the City Commission desires to put property owners on notice of the location of a proposed street and highway, across certain property where no street or highway exists, for the purpose of preserving the rights of all affect- ed persons so as to preclude excessive damages and inconveniences at the time the streets are opened and extended, and, WHEREAS, Article ll05a, Revised Civil Statutes of Texas provides .for the establishment of building lines on any part or side of any street in the City of Lubbock, said City having a population of more than 15,000, and, I WHEREAS, immediate designation of building lines is required in the interest 1, and preservation of public safety and property in and along that portion of 19th 11 Street as herein described, and the establishment of such building lines is 1\ necessary to preclude further buildings, structures, trees, fences or improvements of any nature being placed within the area required for right-of""Way, and the I establishment of such building lines and the improvements to be made on the right• of-way will ultimately provide a street and highway of needed width and traf'fic capacity, THEREFORE, BE IT ORDAINED BI THE CITY COMMISSION OF THE CITY OF LUBOOCK, TEXAS: ... SECTION 11 That, a building line is hereby established on th\ North side of u. s. SECTION 4S That all structures on 19th Street now extending within such ! building lines established b.f description in Sections 1 and 2 of this Ordinance, are hereby required to conform to the new buildizlg lines established by said sections within a period of not more than five years from the effective date of thie Ordinance. SECTION 5: It shall be unlawtul for 8JV person, firm, corporation, trustee or ~ authorized agent or representative thereof to erect, reconstruct or sub- stantially repair a~ building or other structure, or to erect or re·erect ~ new building or other structure within or between the building lines established and l described in Sections 1 and 2 ot this Ordinance, and whoever shall violate aey provisions of this Section shall, upon conviction, be fined not exceeding $lOo.oo. SECTION 6: lhe provisions or Section 5 ot this Ordinance shall not apply to 1 arq officer, agent, employee or other person duly' authorized by the State of Texas aid/or the City of fubbock when performing an-, empla,yment pursuant to the widening, I straightening or extension of the street and/or right-of~ contemplated b.r this Ordinance. t AND IT IS SO ORDERED.
