AN ORDINANCE CREATING AND ESTABLISHING A DEPART-
MENT OF MUNICIPAL .GOVERNMENT TO THE CITY OF LUBBOCK TO BE KNOWN
AS THE DEPARTMENT OF RECREATION; CREATING A RECREATION COUNCIL
AND PRESCRIBING ITS DUTIES AND PROVIDING FOR FINANCING THE
DEPARTMENT.
WHEREAS, the City of Lubbock, Texas, is a Home
Rule City, operating under the Home Rule Charter voted by the
citizens of Lubbock, vesting it with full power and authority
of self government. The City ~f Lubbock has a population of
approximately 40,000 inhabitants and owns and maintains many city ,
parka and play grounds in its corporate limits and maintains
and operates MacKenzie State Park under an agreement with the
State of Texas. Said parks and play grounds owned and/or con-
trolled and operated by the City consist of several hundred acres
of land. And,
WHEREAS, thousands of children and adults patronize
said parks and play grounds annually seeking recreation and re-
laxation and, whereas, the City of Lubbock has no Department of
Recreation to conduct, supervise and carry on a much needed
public recreational program. And,
WHEREAS, the City Commission finds that it will be
to the be'st interest of the general public for the City Commission
to create, establish and maintain a Department of Recreation
to promote, carry on and supervise a public recreation program,
and that a public recreation program should be maintained and
operated by the City of Lubbock in connection with ita parks,
play grounds and at such public places in the corporate limits
to the City of Lubbock as the interest of the public may re-
quire.
THEREFURE, BE IT ORDAINED BY THE CITYCOMMISSION
OF THE CITY OF LUBBOCK:

·sECTION 1: There is hereby created a Depart-
)
~ ment of the municipal ·government of the City of Lubbock a
Department of Recre~ion; said Department shall be operated and
administered by the City. of Lubbock, as hereinafter provided.
SECTION 2: Fbr the purpose of operating and
administering the Department of Recreation there is hereby
created a Council to be composed of 7 members who shall
.serve without pay, and all of whom shall be resident,-tax paying
citizens of the City of Lubbock. Said council shall be
officially designated as the Recreation Council.
The members of the Recreation Council shall be
appointed by the City Commission and hold office at the will and
pleasure of the said City Commission.
The City Commission shall appoint 3 of the
members of the first Recreation Council to serve for a perio~
of 2 years, and 4 members to serve for a period of 4 years and
thereafter all members appointed shall serve for a period of
4 years except appointments made to fill unexpried terms.
SECTION 3: The Recreation Council is hereby
vested with full power and authority to set up and operate a
public recreation program in the City of Lubbock, to promote and
supervise indoor as well as outdoor recreation, to supervise
and operate all soft ball diamonds, baseball diamonds, tennis
courts, croquet courts, basket ball courts and any and all
other ·sports and games played on the public play grounds and
parks belonging to the City of Lubbock; to supervise, direct
and stage theatric and dramatic ~lays and with the ~ight to
promote any and all kinds of clean, wholesome entertainment for
the promotion of good morals, good health and good citizenship.
SECTION 4: The Recreation Council is hereby
vested with power and au thority to appoint a Superintendent of
the Recreation Department who shall hold his office at the Will

~ and pleasure of the Recreation Council. The Superintendent of
the Department of Recreation shall with the advise and consent of
a majority of the members of the Recreation Council, employ
and discharge all paid personnel! of said Department and shall
be responsible to the Recreation Council for the faithful and
efficient operation of said Department.
The salary of the Superintendent of Recreation
and all paid employees of said Department shall before they
become effective, be approved by the Recreation Council and
such salaries shall be set forth in the budget of the Department
of Recreation as approved by the City Commission.
SECTION 5: The Recreation Council shall within
ten days after its members are appointed, meet and organize.
At its first meeting it shall elect one of its members as Chairman
and one as Vice-Chairman and one as Secretary. It shall be the
duty of the Chairman to preside at all meetings and in the absence
of the Chairman, the Vice-Chairman shall preside.
A majority of the members of the Recreation
·council shall constitute a quorum for the transaction o~ business.
The Recreation Council shall hold regular
meetings once each month in the corporate limits ~n the City of
Lubbock, at such time and place as the Chairman may designate.
The Chairman shall call special meetings of the
Recreation Council when necessary.
The Recreation Council shall keep accurate and
complete minutes and records of all its meetings, a copy of
said minutes and records to be filed with the City ·secretary in
the City Hall. It Bhall be the duty of the Recreation Council
to see that said minutes and records are kept by the Secretary
and that a copy of said minutes and records are filed with the
City Secretary.

SECTION 6: It shall be the privi.lege of the City
l\llanager to meet with the Recreation Council as often as his duties
will permit and to counsel and advise With said Council and to
keep the City Commission fully advised and informed as to the
activities of the Recreation Council.
SECTION 7: The Recreation Council shall before
March the first of each year, prepare and submit to the City
'
Commission an itemized budget of the Department of Recreation,
showing the funds needed to operate and maintain the Department
of Recreation for the next ensuing fiscal year. Said budget as
approved by the City Commission shall be incorporated in the
general budget of the City of Lubbock and upon the approval of
the gene~al budget of the City of Lubbock the fUnds as approved
for operation and maintenance of the Department of Recreation
shall be appropriated from the general fund as needed.
The funds appropriated for the Department of
Recreation shall be expended under the direction of the Recreation
Council and shall be handled through the accounting department
of the City of Lubbock, in the same manner as funds appropriated
for other departments of the City.
SECTION 8: The Recreation Council may when it
deems it proper and necessary, make recommendations to the City
Commission for the purchase and/or renting of suitable buildings
and grounds to be used in the operation of the Department of
Recreation, but the City Commission reserves to itself the right
to make all contracts for the purchase and rental of buildings
and real estate.
SECTION 9: All requests for the purchase of
equipment and supplies shall be made on a signed purchase re-
quisition. Said requisition to be signed by the Superintendent

of the Department of Recreation and a member of the Recreation
Council who has been authorized by the Council to sign such
requisition and any requisition not so signed shall not be honored
by the City purchasing agent.
SECTION 10: Since the responsibility for the
construction, maintenance and upkeep of the City Parks and Public
Play Grounds is under the supervision and direction of the Park
Commission of the City of Lubbock, it shall be necessary for the
Recreation Council before instituting any recreational program
·or installing any recreation facilities on the City Parks or
Play Grounds to submit to and have the approval of the Park
Commission on such plana· for recreational programs and the
location and installation for recreation facilities so that the
use of the parks and public play grounds by the Department of
Recreation shall not interfere with the development, maintenance
and upkeep of the City parka and play grounds by the Park
Commission.
SECTION 11: The Recreation Council is hereby
vested with power and authority to adopt by-laws, rules and
regulations governing the operation and supervision of a public
Recreation program in the City of Lubbock, provided said by-laws,
rules and regulations are not in conflict with the City Charter,
the Constitution and laws of the State of Texas.
