ORDINANCE NO. 8857
AN ORDINANCE AMENDING CHAPTER 6, ARTICLE III OF THE CODE OF ORDINANCES,
CITY OF LUBBOCK, TEXAS, ENTITLED "PLUMBING CODE"; BY ADOPTING THE UNIFORM
PLUMBING CODE, 1985 EDITION; PROVIDING THAT THE BUILDING OFFICIAL SHALL BE
THE ADMINISTRATIVE AUTHORITY TO ENFORCE SAID CODE; BY RENUMBERING SECTION
6-81.1; BY ESTABLISHING TO WHOM PERMITS MAY BE ISSUED; BY DELETING REFER-
ENCES TO THE 1982 EDITION; BY ADDING TWO MEMBERS TO THE PLUMBING AND
MECHANICAL BOARD WITH STATED QUALIFICATIONS; BY LIMITING SAID BOARD
MEMBERS' SERVICE TO TWO CONSECUTIVE TERMS; PROVIDING FOR ELECTION OF A
CHAIRMAN TO SAID BOARD AND APPOINTING THE BUILDING OFFICIAL AS ITS SECRE-
TARY; BY REPEALING THE REQUIREMENTS FOR A PLUMBER'S BOND AND A GAS APPLI-
ANCE, LAWN SPRINKLER AND WATER SOFTENER DEALER'S BOND; BY REPEALING
SECTIONS MADE MOOT BY THE 1985 EDITION OF THE UNIFORM PLUMBING CODE; BY
AMENDING SECTIONS TO CONFORM WITH NEW NUMBERING IN THE 1985 EDITION OF THE
UNIFORM PLUMBING CODE; PROVIDING FOR A PENALTY; PROVIDING A SAVINGS CLAUSE
AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed amendment to the·Plumbing Code has been recom-
mended by the Plumbing and Mechanical Board; and
WHEREAS, the City Council has found the proposed amendment to be
expedient and in the interest of the public health, safety and general
welfare; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 6-81 of the Code of Ordinances, City· of
Lubbock, Texas, is hereby amended to read as follows:
"Sec. 6-81. Uniform Plumbing Code, 1985 Edition, adopted.
The 1985 edition of the Uniform Plumbing Code as copyrighted in
1985 by the International Association of Plumbing and Mechanical
Officials, Los Angeles, California, along with the appendices thereto,
as amended in this article, is specifically adopted as the Plumbing
Code of the City, and incorporated herein by reference as though set
out completely in detail. References in this article to the Uniform
Plumbing Code shall mean the 1985 Edition. A copy of said Uniform
Plumbing Code as hereinafter amended shall be filed with the City
Secretary and a copy maintained in the office of the Building Offi-
cial, all such copies to be open to the public inspection during
business hours of the offices where they are maintained with the
amendments thereto provided in this article.''
SECTION 2. THAT the Code of Ordinances, City of lubbock, Texas, is
hereby renumbered as follows:
Section 6-81.1 shall become Section 6-81.2.

il SECTION 3. THAT the Code of Ordinances, City of Lubbock, Texas, is
I[ hereby amended by adding a section, to be numbered 6-81.1, which said ii section reads as follows:
"Sec. 6-81.1. §20.1. Administrative Authority.
Section 20.1 of the Uniform Plumbing Code is hereby amended to
add the following:
The Administrative Authority duly appointed to enforce this Code
shall be the Building Official of the City of Lubbock, however, said
Building Official is hereby authorized to designate qualified employees
serving under his direction and control to assist in the discharge of
such duty."
SECTION 4. THAT the Code of Ordinances of the City of Lubbock, Texas
is hereby amended by adding a section, to be numbered 6-81.3, which said
section reads as follows:
"Sec. 6-81.3. Application for permit.
Section 20.6 of the Uniform Plumbing Code, is hereby amended by
adding the following paragraph at the beginning of Section 20.6:
Permits for all plumbing work shall be issued only in the name of
a person who is a licensed master plumber or to persons expressly
exempt from complying with the Plumbing License Law of 1947.
(Tex.Rev.Civ.Stats., art. 6243-101). Permits for gas piping
shall be issued only in the name of a person who is a master
plumber."
SECTION 5. THAT Sections 6-81.1 through 6-86 of the Code of Ordinances
of the City of Lubbock, Texas, are hereby amended by deleting the phrase,
"1982 Edition," wherever it appears in said Sections.
SECTION 6. THAT Section 6-83 of the Code of Ordinances of the City of
Lubbock, Texas, is hereby amended to read as follows:
"Sec. 6-83. §20.14. Plumbing and Mechanical Board.
Section 20.14 of the Uniform Plumbing Code, is hereby amended to
read as follows:
(a) Plumbing and Mechanical Board. There is hereby created a
Board to be known as the Plumbing and Mechanical Board for
the City of Lubbock, Texas.
(b) The Board shall consist of nine (9) members who shall serve
without compensation. The membership of said Board shall be
as follows:

(1) City Building Official, or his designated representative,
who shall be an ex officio member of the Board without
voting privileges, and shall continue as such while
holding this office.
(2) City Senior Plumbing Inspector, who shall be an ex
officio member of the Board without voting privileges,
and shall continue as such while holding this office.
(3) Either two (2) licensed and active master plumbers or
one licensed and active master plumber and one licensed
and active journeyman plumber.
(4) five (5) members, other than master or journeyman
plumbers:
a. A professional engineer registered in the state,
b. A general building contractor,
c. A citizen of the City of voting age,
d. A state licensed mechanical contractor, and
e. A residential home builder.
(c) The members currently serving on the Plumbing and Mechanical
Board as of the passage of this article shall continue to
serve in such capacity until the expiration of the term of
office to which they are appointed. The two (2) new members
required by this Ordinance (Sec. 6-83(b)(4)d & e) shall be
appointed for an initial term to expire December 31, 1986.
Thereafter all appointments of the seven (7) voting members
shall be for a term of two (2) years. No voting member of
the Board shall serve for more than two (2) consecutive full
terms. The chairman shall be elected by the voting members
of the Board annually at the regular meeting in January.
(d) If for any reason, any of the members of the Board shall be
unable to act, or shall resign from their respective
positions or shall be removed for any cause, then the City
Council shall appoint a successor or successors, who shall
fill out the unexpired term or until respective successors
shall be appointed.
(e) The City of Lubbock shall provide the Plumbing and Mechan-
ical Board with proper books of record, blank forms,
stationery and supplies proper and adequate for the conduct
of its business.
(f) The Plumbing and Mechanical Board shall meet on a regular
basis, said meetings to be determined by the Board. The
Building Official or his designated representative shall act

as secretary to the Board and shall keep a full record of
the proceedings of all meetings of the Plumbing and Mechan-
ical Board.
It shall be the power and duty of the Plumbing and Mechan-
ical Board to examine new developments and changing condi-
tions for additions, deletions, amendments and changes to
the "Plumbing Code" from time to time as it may deem proper,
and to submit to the City Council its written suggestions
for the improvement of the "Plumbing Code" of the City of
Lubbock.
Appeals to the Plumbing and Mechanical Board may be made by
the City Building Official or any interested person and it
is hereby made the power and duty of the Plumbing and
Mechanical Board when disputes arise between any person,
firm, association, partnership or corporation as to the
meaning of the "Plumbing Code," to interpret same; and when
a majority of said Plumbing and Mechanical Board has
interpreted the "Plumbing Code" as to its meaning, said
interpretation by said Plumbing and Mechanical Board shall
be final and binding on all persons, firms, associations,
partnerships and corporations.
All of the members of the Plumbing and Mechanical Board
shall be residents of the City of Lubbock and actively
engaged in their respective fields.
In cases where the Uniform Plumbing Code, gives discretionary
power to the Building Official to permit deviation from the
provisions of said Code, only those deviations or changes
approved by the building official involving required mate-
rial substitutions must also be approved by the Plumbing and
Mechanical Board before same can be performed in the City of
Lubbock."
SECTION 7. THAT the Code of Ordinances, City of Lubbock, Texas, is
hereby amended by repealing Sections 6-84, 6-85, 6-8~.5, 6-85.8 and
6-85.29.
SECTION 8. THAT Section 6-85.2 of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
"Sec. 6-85.2. §117(k). Private sewage disposal system.
Section 117(k) of the Uniform Plumbing Code shall read as follows:
(k} Private sewage disposal system. Private sewage disposal
system is a septic tank with the effluent discharging into a
subsurface disposal field."

SECTION 9. THAT Section 6-85.16 of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
"Sec. 6-85.16. Table 7-2 -Grease traps.
Table 7-2, p. 59 of the Uniform Plumbing Code be and is hereby
deleted in ita entirety."
SECTION 10. THAT Section 6-85.17 of the Code of Ordinances of the
City of Lubbock, Texas, is hereby amended to read as follows:
"Sec. 6-85.17. §714. Sand traps.
A new Section 714 is hereby added to the Uniform Plumbing Code
and shall read as follows:
Approved sand traps shall be installed in all service stations,
public garages, steam cleaning plants and other commercial buildings
where the washing or steam cleaning of automobiles, trucks, machinery,
or similar items is done. Such sand traps shall be considered
approved when constructed in accordance with the sand trap detail
diagram, a copy of which shall be maintained in the building inspec-
tion office."
SECTION 11. THAT Section 6-85.18 of the Code of Ordinances of the
City of Lubbock, Texas, is hereby amended to read as follows:
"Sec. 6-85.18. §715. Interceptors and traps for special wastes.
A new Section 715 is hereby added to the Uniform Plumbing Code
and shall read as follows:
Interceptors and traps for special wastes, such as for dental,
medical or surgical purposes, and such as for special industrial
processes to prevent the discharge of undesirable suspended solids to
the sanitary sewer collection system, shall be installed where needed
and shall be approved by the Building Official and the engineering
department for the use, before installation."
SECTION 12. THAT violation of any provision of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed Two Hundred
Dollars as provided in Section 6-81.2 (as renumbered herein) of the City
Code.
SECTION 13. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.

SECTION 14. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.
