AN ORDINANCE AMENDING CHAPTER 6, ARTICLE IV Of THE CODE Of ORDINANCES,
CITY Of LUBBOCK, TEXAS, ENTITLED "MECHANICAL CODE;" BY ADOPTING THE UNifORM
MECHANICAL CODE, 1985 EDITION; PROVIDING fOR A CHANGE IN THE PREfACE Of
SEC. 6-103 TO COMPLY WITH CHANGES IN 1985 EDITION Of UNifORM MECHANICAL
CODE; PROVIDING THAT THE BOARD Of APPEALS SHALL HAVE THE DUTY TO RECOMMEND
CHANGES TO THE "MECHANICAL CODE" AS IT MAY DEEM PROPER; PROVIDING fOR A
PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING fOR PUBLICATION.
WHEREAS, the proposed amendment to the Mechanical Code has been
recommended by the Plumbing and Mechanical Board; and
WHEREAS, the City Council has found the proposed amendment to be
expedient and in the interest of the public health, safety and general
welfare; NOW THEREfORE:
BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK:
SECTION 1. THAT Section 6-101 of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
••section 6-101. Uniform Mechanical Code, 1985 Edition, adopted.
The 1985 Edition of the Uniform Mechanical Code, as copyrighted
in 1985 by the International Conference of Building Officials,
Whittier, California, and the International Association of Plumbing
and Mechanical Officials, Los Angeles, California, along with the
appendices thereto, as amended in this article, is specifically
adopted as the mechanical code of the city, and a copy is attached to
the ordinance adopting said code and incorporated herein by reference
as though set out completely in detail. References in this article to
the Uniform Mechanical Code shall mean the 1985 edition. A copy of
said Uniform Mechanical Code shall be filed with the city secretary
and a copy maintained in the office of the building official, all such
copies to be open to public inspection during business hours of the
offices where they are maintained, with the amendments thereto
provided in this article."
SECTION 2. THAT Section 6-102 of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
"Section 6-102. §203. Board of appeals.
Section 203 of the Uniform Mechanical Code is hereby amended by
making the following amendments:

In order to determine the suitability of alternate material and
methods of installation and to provide for reasonable interpretations
of this code, there shall be and there is hereby created a board of
appeals, whose membership shall be the same as that of the plumbing
and mechanical board of the City of Lubbock. The building official
shall be an ex officio member and shall act as secretary of the board.
The board shall adopt reasonable rules and regulations for conducting
its investigations and shall render all decisions and findings in
writing to the building official with a duplicate copy to the appel-
lant.
It shall be the power and duty of the board to examine new
developments and changing conditions for additions, deletions, amend-
ments and changes to the "mechanical code" from time to time as it may
deem proper, and to submit to the City Council its written suggestions
for the improvement of the "mechanical code" of the City of Lubbock."
SECTION 3. THAT Section 6-103 of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
"Section 6-103. §204. Violations and penalties.
Section 204 of the Uniform Mechanical Code, is hereby amended by
adding a second paragraph to read as follows:
Any person, firm or corporation violating any provisions of this
code shall be deemed guilty of a misdemeanor, and each such person
shall be deemed guilty of a separate offense for each and every day or
portion thereof during which any violation of any of the provisions of
this code is committed, continued or permitted, and upon conviction of
any such violation such person shall be punishable by a fine of not
more than two hundred dollars ($200.00)."
SECTION 4. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed two hundred
dollars as provided in Section 6-103 of the City Code.
SECTION 5. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 6. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
