HomeMy WebLinkAboutOrdinance - 8850-1985 - Amending Ch. 2 Of The Code Of Ordinances, Entitled "Administration" - 11/14/1985LJM:da First Reading November 14, 1985 Agenda Item #26 Second Reading November 21, 1985 Agenda Item #7 ORDINANCE NO. 8850 ------- AN ORDINANCE AMENDING CHAPTER 2 Of THE CODE Of ORDINANCES, CITY Of LUBBOCK, ENTITLED "ADMINISTRATION," BY ADDING A NEW ARTICLE XXI TO BE ENTITLED "MUNICIPAL BOARD ON SIGN CONTROL;" PROVIDING fOR THE CREATION Of SUCH BOARD, SETTING fORTH THE BOARD'S MEMBERSHIP, QUALIFICATIONS, DUTIES, TERM METHOD Of SELECTION, AND EX OffiCIO MEMBERSHIP; PROVIDING FOR A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City of Lubbock has a sign ordinance (Sec. 29-26) which requires relocation, reconstruction or removal of some signs within the ! ;J City; and WHEREAS, TEX.REV.CIV.STAT.ANN. Art. 1015o requires appointment of a municipal board on sign control in such circumstances; and WHEREAS, the City Council has found it to be in the best interest of the citizens of Lubbock to provide for the creation of such a board; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK: SECTION 1. THAT the Code of Ordinances, City of Lubbock, Texas, is hereby amended by adding an Article to Chapter 2, to be numbered Ch. 2, Article XXI, which said Article reads as follows: "Article XXI. · Municipal Board on Sign Control Sec. 2-546. Municipal Board on Sign Control -Creation. Pursuant to TEX.REV.CIV.STAT.ANN. Art. 1015o, there is hereby created a municipal board on sign control to consist of five (5) members. Sec. 2-547. Powers and Duties. The municipal board on sign control shall have all powers and perform all duties vested in the board by or under said Art. 1015o. Sec. 2-548. Ex Officio Member, Secretary. The Codes Administrator of the City of Lubbock shall be an ex officio member of the board without the power to vote and in such capacity shall act as secretary to the board and shall set up and maintain the minutes and record of all board activities, actions, notices, attendance, orders and proceedings. Sec. 2-549. Appointment. The members of the municipal board on sign control shall be appointed by the Mayor as the presiding officer of the governing body of the City of Lubbock. Sec. 2-550. Term. Members of the board shall be appointed for a term of two (2) years. Sec. 2-551. Qualifications of Members. The membership of the board shall be composed of the following 1 persons: (a) Two persons who must be real estate appraisers registered with the Society of Real Estate Appraisers or the American Institute of Real Estate Appraisers; (b) On person who must be engaged in the sign business in the City of Lubbock; (c) One person who must be an employee of the State Department of Highways and Public Transportation and must be familiar with real estate valuations in eminent domain proceedings; and (d) One person who must be an architect or a landscape architect licensed by the State of Texas." SECTION 2. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. - 2 - ... .
