First Reading October 24, 198 Agenda Item #11 8~0 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 70a4 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2542; A CHANGE OF ZONING FROM R-1 TO C-2 UNDER PROVISIONS OF SECTION 29-29 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK ON A TRACT OF LAND OUT OF SECTION a, BLOCK E, LUBBOCK COUNTY, TEXAS; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 29-J1(a) OF THE ZONING ORDINANCE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordin- ances, City of Lubbock, Texas, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, and notice was duly published in the lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room of the City Hall, lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2542 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: A change of zoning from R-1 to C-2 under provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock on a tract of land out of Section B, Block E, Lubbock County, Texas, located at the northeast corner of 98th Street and Avenue P and being further described as follows: METES AND BOUNDS DESCRIPTION of a 2.062 acre tract of land located in the Southwest Quarter of Section a, Block E, Lubbock County, Texas, being further described as follows: BEGINNING at a set 1/2" iron rod with cap which bears N. 00°0a' W. a distance of 59.50 feet and N. 89°48' E. a distance of 40.00 feet from the Southwest corner of Section B, Block E, Lubbock County, Texas; .. I I . THENCE N. 00°08' W. along the East right-of-way line of Avenue "P", a distance of 355.65 feet to a set 1/2" iron rod with cap; THENCE N. 89°48' E. along the North line of a 56 foot right-of-way easement, a distance of 278.30 feet to a set 1/2" iron rod with cap; THENCE S. 00°01'30" W. a distance of 205.90 feet to a found 1/2" iron rod; THENCE N. 89°57' W. a distance of 60.00 feet to a found 1/2" iron rod; THENCE S. 00°01'30" W. a distance of 150.00 feet to a 1/2" iron rod found in the North right-of-way line of 98th Street; THENCE S. 89°48' W. along the North right-of-way line of 98th Street, a distance of 217.30 feet to the Point of Beginning. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed the limits provided in Section 29-31(a) of the Zoning Ordinance of the City of lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
