AN ORDINANCE AMENDING CHAPTER 6 OF THE CODE OF ORDINANCES, CITY OF 11 H LUBBOCK, ENTITLED "BUILDINGS AND BUILDING REGULATIONS"; BY AMENDING THE I BUILDING CODE AND THE PLUMBING CODE BY REPEALING THE REQUIREMENTS FOR A : 1 .: BOND FOR GENERAL CONTRACTORS, OTHER CONTRACTORS, INSULATION CONTRACTORS/IN- : STALLERS AND BUILDING MOVERS; BY RENUMBERING SECTIONS 6-2B(d) AND (e); ~~~. PROVIDING FOR THE REQUIREMENT OF A CERTIFICATE OF INSURANCE PRIOR TO THE i ISSUANCE OF ANY PERMIT REQUIRED IN THIS CHAPTER WITH CERTAIN EXCEPTIONS; !'PROVIDING FOR A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR !-PUBLICATION. j' WHEREAS, the requirement of filing of bonds by various contractors has j proven to be an ineffective protection for the citizens of lubbock; and 1 \ WHEREAS, the requirement of filing a bond has proved to be unnecessary lj burden upon the contractors operating in the City of lubbock; and i WHEREAS, both the Building Board of Appeals and the Plumbing/Me- . chanica! Board have recommended to the City Council of lubbock that such ' bond requirements be repealed as being obsolete and not of any good use; and WHEREAS, the City Council of the City of lubbock has found that it is no longer in the public interest to require such bonds; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 6-25 of the Code of Ordinances, City of lubbock, Texas is hereby amended to read as follows: "Sec. 6-25. Table No. 3-A. Table of fees. Chapter 3 of the Uniform Building Code is amended by deleting Table No. 3-A. Building Permit Fees." SECTION 2. THAT the Code of Ordinances, City of lubbock, Texas, is hereby amended by repealing Sections 6-26 and 6-27. SECTION 3. THAT the Code of Ordinances, City of lubbock, Texas, is hereby amended by repealing subsection (c) of Section 6-28 and renumbering said Section as follows: Section 6-28(d) shall become 6-28(c) Section 6-28(e) shall become 6-28(d) SECTION 4. THAT the Code of Ordinances, City of Lubbock, Texas, is hereby amended by adding a new section to be numbered 6-26, which said section reads as follows: "Sec. 6-26. §308. Certificate of Insurance Required. A new section 308 is hereby added to Chapter 3 of the Uniform Building Code, which shall read as follows: Any person or persons, firm, corporation or association seeking to acquire any permit required under this Chapter shall have in force the following insurance: {a) $100,000 of comprehensive general liability insurance, per occurrence, including coverage for bodily injury and property damage with products liability and completed operations coverage, and {b) Workman's compensation coverage in accordance with the requirements of state law. Prior to issuance of any such permit, such applicant shall furnish the Building Official with a certificate of insurance evidencing the required insurance coverage. The insurance coverage shall include a provision that in the event such coverage is canceled or reduced, the insurance carrier shall notify the Building Official at least ten (10) days prior to such cancellation or reduction in coverage. An applicant's permit shall be automatically suspended during any period in which the applicant fails to maintain in effect the required insurance coverage. This provision shall not a~ply to the following: (1) a homeowner seeking a permit to work on his own residence. (2) a homeowner seeking a permit to personally do work on other homes owned by him. -2- . ' ii II SECTION 5. THAT the Code of Ordinances, City of Lubbock, Texas, is hereby amended by adding a new section to be numbered 6-84, which said section reads as follows: "Sec. 6-84. §20.15. Certificate of Insurance Required. A new section 20.15 is hereby added to Part 1 of the Uniform Plumbing Code, which shall read as follows: Any person or persons, firm, corporation or association seeking to acquire any permit required under this Chapter shall have in force the following insurance: (a) $100,000 of comprehensive general liability insurance, per occurrence, including coverage for bodily injury and property damage with products liability and completed operations coverage, and (b) Workman's compensation coverage in accordance with the requirements of state law. THAT violation of any provision of this Ordinance shall be ,deemed a misdemeanor punishable by a fine not to exceed Two Hundred Dollars as provided in Sections 6-20 and 6-81.1 of the City Code, whichever is applicable. SECTION 7. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. -3- / SECTION 8. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
