Home My WebLink AboutOrdinance - 8829-1985 - Amending Zoning Ordinance #7084 By Increasing The Penalty For Violation - 09/26/1985DGV:js First Reading September 26. 1985 Agenda Item #18 Second Reading October 10, 1985 Agenda Item #11 ORDINANCE NO. 8829 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 BY INCREASING THE PENALTY FOR VIOLATION OF ANY OF THE PROVISIONS OF ORDINANCE NO. 7084; PROVIDING A SAVINGS CLAUSE; AND PROVIDING A PENALTY. WHEREAS, the Texas Legislature has amended Vernon's Ann.Civ.St., art. 1200gg, to provide the Lubbock Municipal Court of Record the same jurisdic- tional fine amounts as is provided to non-record municipal courts within the State of Texas; and WHEREAS, Vernon's Ann.C.C.P., art 4.14, provides that municipal courts may impose fines not exceeding One Thousand Dollars ($1,000.00) in all cases arising under the ordinances of a city governing fire safety, zoning and public health and sanitation, other than vegetation and litter viola-. tiona; and WHEREAS, this proposed change in the Zoning Ordinance has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council.finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make this proposed change in the Zoning Ordinance; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance have been fully complied with, as well as giving notice in compliance with Section 29-29 of the Code of Ordinances .of the City of Lubbock and Vernon's Ann.Civ.St., art. 1011f, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen {15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice and publication was duly held in the City Council Room of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to the first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the penalty provision of Ordinance 7084, included in the Code of Ordinances of the City of Lubbock as Section 29-31, BE and is hereby amended to read as follows: Sec. 29-31. Penalties for violations. (a) Any person, landowner, building owner or occupant, who shall violate any of the provisions of this Ordinance (chapter) or who shall fail to comply with any of the provisions of this Ordinance (chapter) or who shall build, alter, or occupy any building, structure of land in violation of any statement of plan submitted and approved hereunder shall be guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not to exceed One Thousand Dollars ($1,000.00). Each day such violation is committed or permitted to continue shall consti- tute a separate offense, and shall be punishable as such hereunder. (b) The owner or owners of any building or property or part thereof where anything in violation of this Ordinance (chapter) shall be placed or shall exist and any architect, building contractor, agent, attorney, person, firm, or corporation employed in connection therewith and who have assisted in the commission of such violation shall be guilty of a separate offense, and upon conviction thereof, shall be fined in any amount not to exceed One Thousand Dollars ($1,000.00). (c) In addition to the remedies provided for above, the adminis- trator may, in case any buildings or structures are erected, construc- ted, reconstructed, altered, repaired, converted, or maintained, or any building, structure or land is used in violation of this Ordinance (chapter), institute on behalf of the City of Lubbock any appropriate action or proceedings to prevent such unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance, or use, to restrain, correct or abate such violation, to prevent any illegal act, conduct of business or use in or about such premises. SECTION 2. THAT should any paragraph, sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
