HomeMy WebLinkAboutOrdinance - 8799-1985 - Amending Zoning Ordinance #7084 And Lubbock Map Changes: Zone Case #2534 - 07/25/1985. ~ LJM:js First Reading July 25, 1985 Agenda Item #9 Second Reading Agenda Item #8 August 8, 1985 ORDINANCE NO. 8799 --------- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK 50 AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2534 ; CHANGE A TRACT OF LAND OUT OF SECTION 9, BLOCK E, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM T TO M-1 ZONING DISTRICT UNDER PROVISIONS OF SECTION 29-29 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-4 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY OF LUBBOCK: ZONE CASE NO. 2534 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: Change a tract of land out of Section 9, Block E, City of Lubbock, Lubbock County, Texas, from T to M-1 Zoning District, located West of Avenue P and about 1247' South of 82nd Street and subject to condi- tions: 'I BEGINNING at a 5/8" iron rod with cap, found for the Northwest corner of this tract and the Northeast corner of 5.14 acre tract, from whence the Northeast corner of Section 9, Block E bears North, 1247.58 feet and North, 89°57'00" East, 340.0 feet; THENCE South, a distance of 497.58 feet to a 5/8" iron rod with cap, found for the Southwest corner of this tract and the Southeast corner of a 5.14 acre tract; THENCE North, 89°57'00", at 310.0 feet pass a 5/8" iron rod with cap, found in the West line of Avenue P, continuing for a total distance of 340.0 feet to a point for the Southeast corner of this tract; THENCE North, a distance of 497.58 feet to a railroad spike, set in the Northeast corner of this tract; THENCE South, 89°57'0011 West, at 30.0 feet pass a 1/2" iron rod, set in the West line of Avenue P, continuing for a total distance of 340.0 feet to the PLACE Of BEGINNING. Containing 3.88 acres. SUBJECT TO THE FOLLOWING CONDITIONS: a. That a 7-foot tall solid screening fence be constructed around all outside storage areas. The fence shall be permanently maintained. b. five percent (5%) of the total development lot area shall be landscaped and permanently maintained. The total required landscaping shall be located between the building lines and the adjacent streets (Avenue P). Any landscaping placed in the visibility triangle of a corner lot must be in compliance with Section 29-30(b)(6) i. 2. of the Code of Ordinances of the City of Lubbock. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred 1 dollars as provided in Section 1-4 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. - 2 - • ( SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
