I I First Reading May 23, 1985 A~nda Item #22 Second Reading June 14, 1985 Agenda Item #15 I LJM:da ORDINANCE NO. _8_7_80_. --- I! ,j h I I AN ORDINANCE AMENDING CHAPTER 29 Of THE CODE Of ORDINANCES, CITY Of LUBBOCK, ENTITLED "ZONING", BY ADDING A NEW SUBSECTION 29-26(f)(3); PROVIDING fOR AN ABATEMENT PERIOD fOR NON-CONfORMING SIGNS LOCATED IN ANNEXED AREAS; PROVIDING fOR A SAVINGS CLAUSE; PROVIDING A PENALTY AND PROVIDING fOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation . 1 '.· which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient I and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordin- ances, City of Lubbock, Texas, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREfORE: BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK: SECTION 1. THAT the Code of Ordinances, City of Lubbock, Texas, is hereby amended by adding a subsection, to be numbered 29-26(f)(3), which said subsection reads as follows: "(3) The abatement periods provided in subsections (f)(1) and (f)(2), immediately above, commenced on the effective date of Ordinance No. 7084, which was July 19, 1975, and were effective as to all such defined non-conforming signs within the corporate limits on such effective date. The abatement periods for the defined non-conforming signs located in areas annexed into the corporate limits on or after the 3r~ day of ,Jul~ , 1985, shall commence to run on the e fective date of annexation of the area in which such non-conforming signs are located. for such purpose the effective date of annexation shall be either the date of final passage of the annexation ordinance involved, or, '~ ~ I i I the date upon which such annexation is approved under the provisions of the Voting Rights Act, which ever action is the last to occur. The abatement periods for the defined non-con- forming signs located in areas annexed between July 19, 1975, and July 3, 1985 , 1985, shall commence to run on the 3rd aay of July ' 1985, or, the date upon the effective date of annexation of the area in which the non-conforming sign is located, which ever action is the last to occur." SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-4 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
