ORDINANCE NO. 8769 .
AN ORDINANCE ABANDONING AND CLOSING TWO PORTIONS Of AN UNDERGROUND
UTILITY EASEMENT LOCATED IN THE AMERICAN STATE ADDITION TO THE,CITY Of
LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY
Of THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OffiCIAL MAPS Of
THE CITY Of LUBBOCK TO REfLECT SAID ABANDONMENT AND CLOSING; PROVIDING A
SAVINGS CLAUSE; AND PROVIDING fOR PUBLICATION.
WHEREAS, the City Council finds that those portions of the underground
utility easement as hereinafter described in the body of this Ordinance are
no longer needed for public use and it would be in the public interest to
· close, vacate and abandon the same; NOW THEREfORE:
BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK:
SECTION 1. THAT those portions of the underground utility easement
as hereinafter described in two tracts shall BE and the same are hereby
closed, vacated and abandoned for easement purposes and for public use;
TRACT 1
A portion of an underground utility easement South of 13th Street,
North of 15th Street and East of Lot A, G.A. Rush Addition Replat,
East of Lot 11, Block 3, G.A. Rush Addition and West of Lot C, G.A.
Rush Addition Replat, to the City of Lubbock, Lubbock County, Texas
and being more particularly described as follows:
BEGINNING at a point 292.4 feet South of the Northwest corner of Lot
C, G.A. Rush Addition Replat, and the Northeast corner of this
description;
THENCE South along the East line of Paris Avenue, 69.6 feet to a
railroad spike set at the P.C. of a curve to the left;
THENCE Southeast along the curve to the left, an arc distance of 70.39
feet to an "x" on concrete, said curve has a radius of 61.0 feet, a
central angle of 66°06'50" and a chord that bears South 33°03'25"
East, 66.55 feet;
THENCE South, 4.96 feet to an "x" on concrete;
THENCE East, 13.94 feet to an "x" on concrete, for the P.C. of a curve
to the right;
THENCE Southeasterly along the arc of a curve to the right, an arc
distance of 53.77 feet to an "x" on concrete, for the Southeast corner
of this tract, said curve has a radius of 61.0 feet, a central angle
of 50°30'32" and a chord that bears South 54°34'52" East, 52.05 feet;

of Lot A, G.A. Rush Addition Replat, in the West line of Paris Avenue,
for a corner of this tract;
THENCE North, along the West line of Paris Avenue, 87.6 feet to a
point for the Northwest corner of this tract;
THENCE East, 56.09 feet to the PLACE OF BEGINNING.
TRACT 2
A portion of an underground utility easement West of Lot "B", G.A.
Rush Addition to the City of Lubbock, Lubbock County, Texas, and being
more particularly described as follows:
BEGINNING at an "x" marked on concrete sidewalk, the Southeast corner
of Lot 1, Block 3, G.A. Rush Addition;
THENCE North, 115.0 feet to the Northeast corner of said. Lot 1, Block
3, for a corner of this tract;
THENCE West, 135.0 feet, to the Northwest corner of Lot 3, Block 3,
for the South-Northwest corner of this tract;
THENCE North, 14.5 feet to a concrete nail, set in pavement, for the
Northwest corner of this tract;
THENCE East, 57.87 feet to a concrete nail, for a corner of this
tract;
THENCE North, 5.0 feet to a concrete nail, for a corner of this tract;
THENCE East, 129.88 feet to an "x" in concrete walk in the West line
of Lot B, G.A. Rush Addition;
THENCE Southwesterly around the arc of a curve of a radius of 61.0
feet, 31.37 feet to an "x" marked on concrete curb, said curve has a
central angle of 29°27'59", a tangent of 16.04 feet, and a chord that
bears South 14°35'40" East, 31.03 feet;
