Reading May 9, 1985 Agenda Item #13 l l I ,, I LJM:da ORDINANCE NO. 8766 ------- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OffiCIAL MAP 11 _ 1 Of THE CITY Of LUBBOCK SO AS TO MAKE THE fOLLOWING CHANGES: ZONE CASE NO. 2459-A; CHANGE A TRACT Of LAND OUT Of SECTION 7, BLOCK E-2, CITY Of LUBBOCK, LUBBOCK COUNTY, TEXAS, TO DELETE CONDITION "a" Of ORDINANCE NUMBER 8588, WHICH PROVIDES fOR C-2A ZONING LIMITED TO PROfESSIONAL OffiCES AND CHANGE EXISTING ZONING TO C-2A ZONING; SUBJECT TO CONDITIONS; PROVIDING fOR A PENALTY AS PROVIDED fOR IN SECTION 1-4 Of THE. CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING fOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to I I make :::::A::o:::•:o:::::::. 1:r::::::: :::uired by law for a valid amend- ' ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordin~ , ances, City of Lubbock, Texas, as well as notices provided by Article j 1011f, Vernon's Annotated Civil Statutes, and notice was duly published in Ill the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, I and the public hearing according to said notice was duly held in the City Council Room of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREfORE: BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK: ZONE CASE NO. 2459-A SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: Change a tract of land out of Section 7, Block E-2, City of Lubbock, Lubbock County, Texas, to delete Condition "a" of Ordinance Number 8588, which provides for C-2A zoning limited to professional offices and change existing zoning to C-2A zoning located at the northwest corner of 66th Street and University Avenue, subject to conditions and being further described as follows: All that certain tract of land in Lubbock County, Texas, described by metes and bounds as follows: BEGINNING at a point which bears north 173.9 feet and west 313.17 feet from the southeast corner of Section 7, Block E-2, Lubbock, Texas; THENCE south 123.9 feet; THENCE east 242 feet to a point of curvature; THENCE northeasterly around a curve to the left with radius of 15 feet, a curve distance of 23.56 feet to a point of tangency; THENCE north 390.57 feet; THENCE N 86°25 1 W a distance of 297.48 feet; THENCE S 30° W a distance of 75 feet; THENCE S 18°12'29" E a distance of 247.7 feet to a place of begin- ning. SUBJECT TO THE FOLLOWING CONDITION: a. That the zone case be tied to the site plan and elevations presented to the Council on this date; and b. The C-2A zoning at this location shall be limited to the follow- ing uses as submitted by the proponent: "Sec. 29-16(c). (1) Antique Shop. (2) Arts and Crafts Store. (3) Art Galleries, Commercial. (4) Bake Shop, Candy Store, Delicatessen, Doughnut Shop, Pie Shop. (5) Banks and Savings and Loan Companies. (6) Beauty or Barber Shops. (8) Book or Stationery Shops or Newsstand. (9) Camera Shop. - 2 - (10) Christmas Tree and Christmas Wreath Sales from December 1 thru 26th. (Outside business and display permitted provided that all trees and wreaths and signs are not closer than ten (10) feet to any street property line and provided further that all unsold trees, wreaths, and other items used in conjunction with such sales shall be removed by the follow- ing January 5). (11) Churches. (12) Coin and Stamp Shops. (16) Dress Shop. (17) Drug Store. (19) Florist Shop. (21) Gift Shop. (23) Gun Shop. (24) Hat Shop. (25) Health or Athletic Club. (26) Hobby Shop. (29) Music or Record Shop. (30) Offices. (31) Office Supply-No Printing Operation Permitted. (32) Paint, Tile, Carpet, Wall Covering and Floor Covering Store. (34) Radio and Television Repair Shops. (35) Radio Studio, with no Tower or Antenna. (36) Reducing Studio. (37) Restaurants, When Designed for Service and Consumption of Food Inside the Building Only. (As an incidental use, accessory passout windows for delivery of food to be consumed off-premises not occupied by the restaurant building shall be permitted). -3 - (38) Restaurants with Sales of Mixed Alcoholic Beverages as an "Incidental Use". (41) Shoe or Boot Repair Shop. (42) Shoe Store. (43) Sporting Goods Store. (44) Studios -Art, Teaching, Dance, Music, Drama, Photographic, Interior Decorating. (45) Tailor Shop. (46) Toy Store." SECTION 2. THAT violation of any prov1s1ons of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred I I dollars as provided in Section 1-4 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any ! reason, the remainder of this Ordinance shall not be affected thereby. i I I I I I I! ,, II II '! i SECTION 4.
