And Lubbock Map For Changes: Zone Case #2527. - 04/25/1985First Reading Apri 1 25, 1985 Agenda Item #13 Second Reading May 9, 1985 Agenda Item #12 LJM:da ORDINANCE NO. 8765 ----- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2527; CHANGE A TRACT OF LAND OUT OF SECTION 25, BLOCK A, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM "T" TO M-1 ZONING DISTRICT; SUBJECT TO CONDI- TIONS; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-4 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordin- ances, City of Lubbock, Texas, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2527 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: Change a tract of land out of Section 25, Block A, City of Lubbock, Lubbock County, Texas, from "T" to M-1 Zoning District located north of Idalou Road and approximately 1,500 feet east of Olive Avenue, subject to conditions and being further described as follows: FIELD NOTES on a 6.45 acre tract of land out of the West 240 acres of Section 25, Block A, Lubbock County, Texas and being more particularly described as follows: I I I ii I I I I ,! ll 'i I ! i ! BEGINNING at a 1/2" iron rod set for the SW corner of this tract from whence the NW corner of Section 25 bears S 89°35'25" W, 870.92 feet and N 0°27'20" W, 3,778.06 feet; THENCE N 0°27'20" W a distance of 793.15 feet to a 1/2" iron rod set for the NW corner of this tract; THENCE N 89°35'25" Eat 411.61 feet pass a 1/2" iron rod set in the west bank of an old caliche pit and in all a distance of 530.72 feet to the NE corner of this tract; THENCE S 20°20'50" W a distance of 216.06 feet to a 1/2" iron rod set for corner in an old caliche pit; THENCE S 89°35'25" W a distance of 210 feet to a 1/2" iron rod set for corner set in the west bank of an old caliche pit; THENCE S 3°46'47" E a distance of 561.74 feet to a found 3/8" iron rod for the NW corner of a 1.314 acre tract and a corner of this tract; THENCE S 15°02' E along the West line of a 1.314 acre tract a distance of 242.94 feet to a found 1/2" iron rod for the SW corner of said 1.314 acre tract and theSE corner of this tract; THENCE N 46°23'49" W a distance of 292.74 feet to the place of beginning and containing 6.45 acres of land. FIELD NOTES on a 1.314 acre tract of land out of Section 25, Block A, Lubbock County, Texas and being more particularly described as follows: BEGINNING at a 3/8" iron rod set in the Westerly R.O.W. line of U.S. Highway 62-82, for the Southeast and beginning corner of this tract, whence the Northwest corner of Section 25, Block A bears South 89° 35'25" West, 1237.34 feet and North 0°27'20" West, 4082.26 feet; THENCE North 46°23'49" West, 210.03 feet to a 3/8" iron rod, set for the Southwest corner of this tract; THENCE North 15°21'00" East, 242.94 feet to a found 3/8" iron rod, for the Northwest corner of this tract; THENCE South 46°23'49" East, 325.03 feet to a found 3/8" iron rod, in the Westerly R.O.W. line of U.S. Highway 62-82, for the Northeast corner of this tract; THENCE South 43°36'11" West along the Westerly R.O.W. line of U.S. Highway 62-82, 214.0 feet to the place of beginning. - 2 - Containing 1.314 acres. SUBJECT TO THE FOLLOWING CONDITIONS: a. Landscaping -The lot adjacent to the Idalou Highway 82/62 \shall have five (5) percent of its respective total development lot area landscaped and permanently maintained. b. Outside Storage Fencing -All outside storage areas shall be behind a screening fence six (6) feet in height. Materials shall not be stacked or stored to exceed the height of the screening fence. All storage areas and fencing shall be behind the front building line towards the interior of the lot. c. Exterior Facade Treatment -The building facade that fronts onto Idalou Highway shall be of wooden siding as shown on the site plan. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-4 of the City Code. SECTION J. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
