JWF:rm First Reading Apri 1 11, 1985 Agenda Item #32 Second Reading April 25, 1985 Agenda Item #8 Ordinance No. 8757 AN ORDINANCE AMENDING ORDINANCE NO. 5831 OF THE CITY OF lUBBOCK SO AS TO CHANGE PART OF AN EXISTING 40 MPH SPEED ZONE TO A 45 MPH SPEED ZONE AND AllOWING THE REMAINDER OF SAID 40 MPH SPEED ZONE ON AVENUE H IN THE CITY TO REMAIN A 40 MPH SPEED ZONE AS HEREINAFTER SET FORTH IN THE BODY OF THIS ORDINANCE; AUTHORIZING PlACEMENT OF SIGNS; PRESCRIBING A PENALTY; PROVIDING FOR PUBLICATION; MAKING THIS ORDINANCE CUMULATIVE; PROVIDING A SAVINGS CLAUSE AND EFFECTIVE DATE OF THIS ORDINANCE: WHEREAS, the governing body of the City of lubbock as authorized by Article 6701d, Section 169{b) Vernon's Texas Civil Statutes, finds that certain prima facie speed limits on certain highways are different from what is reasonable or safe and should be altered as hereinafter set forth, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF lUBBOCK: SECTION 1. The prima facie speed limit established by Article 6701d, Section 166 {a){l)--Vernon's Texas Civil Statutes is altered and changed for all vehicles on the following designated highways or streets in the corporate limits of the City of lubbock, lubbock County, Texas: THAT part of Section 1 of Ordinance No. 5831 of the City of lubbock which reads as follows: "A 40 MPH Speed Zone on both sides of Avenue H between 34th Street and the Traffic Circle (South)." Is hereby amended to read hereafter as follows: A 40 MPH Speed limit Zone on both sides of Avenue H between 34th Street and a point which is 300 feet south of the South Curb line of 52nd Street. A 45 MPH Speed limit Zone on both sides of Avenue H beginning at a point which is 300 feet South of the South Curb line of 52nd Street and extending south to the Traffic Circle.•• The remainder of said Ordinance No. 5831 shall remain the same, and shall remain in full force and effect as hereby amended. SECTION 2. The City Manger is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. .. SECTION 3. Any person. firm, or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined any sum not to exceed TWO HUNDRED ($200.00)DOLLARS. SECTION 4. The City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty as an alternative method of publication as provided by law. SECTION 5. That all highways or streets not specifically set forth in the preceding sections hereof shall not be affected by the provisions hereof, and this Ordinance shall be cumulative of all other prima facie speed limit ordinances except those with which it specifically conflicts. SECTION 6. Should any section, paragraph, sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason the remainder of this Ordinance shall not be affected thereby. SECTION 7. This Ordinance shall become effective ten (10) days after the date of its last publication. AND IT IS SO ORDERED. Passed by the City Council on first reading this 11th day of April 1985.
